Q: Hello
I am currently working for a company registered in DMCC free zone.
I have resigned and currently serving my notice period of 30 days, I still have 10 days left to serve.
It seems the employer is delaying the process because he is not taking time to discuss the exit process nor the EOS.
1) If the employer delays or refuses to cancel/transfer the visa, what can I do? I need to cancel/transfer because of a new job waiting for me.
2) Is it legal for the employer to delay or stop the cancellation/transfer?
3) What legal measures can the employee take? Can the employee later file a complaint about the delay and claim damages related to a late start of work, which includes missed salary and work opportunity?
4) In case of disagreement on the EOS, can we still do the cancellation/transfer first, and later settle EOS separately (in order not to delay my new job starting date)?
5) The employer said that the EOS was paid as part of last year bonus? is it legal?

Q: A person e-mails his resignation and leaves for his country from Dubai a year before his 2-year contract ends, without paying the penalty and visa charges as written in the contract.
Would he be considered an absconder? Would he have to face a lifetime ban?

The date of the verbal notification or the date of receiving the written notification?

Since I have been terminated in a company located in Dubai, now I'm in 30 days' notice period. As per the UAE law, is it compulsory to attend the duty in notice period?
Do I have rights to claim in cash for my termination an exit flight ticket?

Terminating a limited contract by an employee after stamping the visa

Q: I got my annual vacation in April. My latest visa is going to expire in Aug 2021. Before I take my annual vacation, my employer put a condition that if I will sign the other contract, he will allow me to have a holiday before the end of the contract.
I signed the MOL contract but still, my visa is not pasted on my passport and I have changed my mind not to continue with the same company. What should I do?
Am I still able to change my company or I need to complete another contract with the same company which is 2 years of the contract?
A contract category is a limited contract.
Please give a suggestion!

How to accelerate cancelation of visa to join another employer?

Q: Hi,
I was working in a private company since 2018 and I renewed my contract last 2020, then I found a new opportunity.
I've submitted my resignation letter last May 2021. I asked only for a 15 day-notice because I need to start with the new company.
It took 2 weeks before they approved my resignation. Now I'm begging for my cancelation, but they're always saying that it is in process already.
Can you give me some advice?

An employer refuses to give an employee his labor dues after waiting for 6 months

Q: Dear sir/madam,
I served my 2 months notice and resigned on the 12th of August as I was supposed to leave the country on the 14th of August during peak COVID time with my dependents.
However, I had to ask for a 1-month extension which would be served with my annual leaves as during peak COVID times, the flights would get canceled without notice. My manager and the HR were kept in the loop and my HR sent me a work permit cancellation letter which I signed and submitted upon confirmation from my manager.
Later when I enquired, my HR said that I am absconding and would receive my settlement after 6 months so I waited. Now after 6 months, on inquiry, HR calls my manager and asks him to inform me that I won't be paid anything as I am absconding.
Now my question is when I have kept everyone in the loop, my manager, the HR with all the steps, how can I be declared absconding.
I have all the emails and chats as proof and would like to know where do I stand legally?

I have worked in this company for more than 3.5 years, but the company suddenly terminated my employment because no site was running.
It has been 20 days since then, and they have not yet canceled my visa or paid my settlement amount.

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
