Q: Hi. My daughter was arrested from our residence in Dubai on 29 August for drugs. We had just got back from vacation two weeks prior, where she had smoked weed. She has spent a month in jail and yesterday was her hearing. She is sentenced to AED 5000 and deportation. We will appeal on Sunday. Question is, what are the charges for us to get her out on bail? Can the deportation be cancelled? We have been living in Dubai for 30 years and have nowhere to send her.

Q: I got charged with possession of drugs, 2 years ago, and executed my judgment 10 months ago (deportation). I applied to the Ruler’s Court for amnesty, to get acquitted of the crime, and have my record cleared. In February 2020, my wishes came true. The Ruler's Court has accepted my plea for mercy and has cleared the deportation and record. I would like to know how do I proceed to come back to the UAE and whether any issues will arise if I do go back. Would I get detained again?

A legal concept upheld by the Federal Supreme Court states that drug use is not prosecuted by UAE courts if the offense occurred abroad. A positive drug test is accepted as proof of drug use, but it does not reveal whether the drug use occurred domestically or abroad. It is necessary to establish the crime's location in order to decide if the UAE courts have the authority to investigate it or if foreign courts should have jurisdiction over it.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this Federal Decree-Law No. (31) of 2021 Promulgating the Crimes and Penalties Law, known as the "New UAE Penal Code", governs criminal actions in the United Arab Emirates.
