كيف يتم إرسال إشعارًا بالإخلاء بعد شراء عقار؟

مرحبًا،

لقد اشتريت منزلًا مؤخرًا وهو مؤجر في الوقت الحالي، لكنني أرغب في الانتقال إليه. ينص القانون على ضرورة إرسال إشعارًا بالإخلاء مدته عام واحد، لكن عقد الإيجار ينص على أنه يحق للمالك عدم تجديد عقد الإيجار بعد إرسال إشعارًا مدته 90 يومًا.

لقد تم توقّيع هذا العقد من قبل المالك السابق، فهل سيكون قابلاً للتطبيق أم يجب عليّ إرسال إشعارًا بالإخلاء مدته عام واحد؟

ينتهي عقد الإيجار في شهر يناير.

Dear questioner,

Concerning your inquiry, as per the civil transactions law, the current obligations shall be transferred in case the property is being sold to a new owner, thus, the new owner shall continue such obligation as per the terms and conditions mentioned in the contract.

Meaning to say that the current tenancy contract shall be valid against you as it is, and the non-renewal notice is different than the eviction notice, the non-renewal notice shall be sent to the tenant 90 days prior to the termination date of the contract.

Therefore, you may send a non-renewal notice to the current tenant which will be valid till January. You will serve him/her a notice of non-renewal 90 days prior to the end date as per the contract, so calculate the days left in the contract and act accordingly.

The seller has not issued any eviction notice, so are we liable to send a 1-year eviction notice, or do we directly share this non-renewal notice?

Dear questioner,

If the time left in the contract is not less than 90 days, then send a non-renewal notice, if not, then you, unfortunately, shall send 12 months eviction notice.

But I am in a confusing state because I asked my tenant who said that this doesn't work out, as the previous owner didn't give him any eviction notice so that it is our responsibility to serve him notice.

So I am very confused, can you please tell me from which government department/authority I can check whether that will work or not, because my 90 day period would start from October 15.

It would be really helpful for me.

Kindly check with the RDC and it is a simple case.

If the previous landlord served notice, then you will continue, and if he didn't, then you can serve a notice upon the current tenancy contract.

Type RDC on google and there you will have the portal to check everything and also you can review Ejary contract T&C's.

Thanks for your kind advice, will be going tomorrow to notary to give the tenant a 3-month non-renewal notice.

You need to draft the notice before you go to the Notary.
