Resignation during the probation period and its consequences
Good afternoon,
I have been working in a nursery as a class teacher. I've left the Job during the probation period. My contract is unlimited. My employer is requiring me the cost of the visa.
For leaving the job during the probation period:
- Shall I pay the proportional costs of the visa?
- Could I face a ban by MOHRE/Employer?
- Shall I communicate 30 days before leaving?
- Should It be as a mutual agreement between both parties, or I can quit the job without the consent of the employer?
Kind regards and thank you in advance.
Dear Questioner,
Please follow my below answers chronologically on your inquiries:
- You should not pay the cost of the visa by the law, but in case it was mentioned in your labour contract, you should pay.
- You could not face a ban from MOHRE.
- Sure, it is your legal right.
- No, there is no agreement, just leave the company, and start looking for a new vacancy. Yes, for sure you can quit the job without the consent of the employer, but you have to send him an official email informing him that you will leave the job, even if he rejects it.
This is for your kind information in advance, and if you have any further question, please feel free to contact me at my email "ms@elnaggarlegal.com".
Thank you.
