Q: Hi,
Actually, I'm working in my father's company and he had given a case against a company for a huge amount.
Now, when I checked the legal document I found that the judgment has been issued and they have seized 26 vehicles.
Now, my dad is not here in Dubai. He handed over a power of attorney to me. This all happened in 2012 and I think judgment came in 2016.
Do I have any hope?

My name is R., I worked in a company from 2013 to 2018.
I had filed a case against my company and won for non-payment of EOS, and the judgment was issued in my favor. Unfortunately, after three years of execution, I am still awaiting my money.
Since the entire process was carried out through a renowned lawyer I have been following up with them since 2019 but with no success.
Please advise how I can get my money.

ادعاء الخصم بيع المنقولات المحجوز عليها قبل قرار الحجز. ماذا أفعل؟
س: السلام عليكم،
ادعى خصمي أنه باع المنقولات المحجوز عليها قبل صدور القرار بوقف التنفيذ في القضية، وأتى بعقد مبايعة مع أحد معارفه بتاريخ سابق لقرار وقف التنفيذ.
أعلم يقينًا أن المبايعة صورية ولم تتم على أرض الواقع وأنها مجرد حبر على ورق، ولكن لا أملك إثباتًا.
هل توجد طريقة قانونية لإجبار البائع أو المشتري ليثبت أنه قام بتسليم أو استلام المبلغ المذكور في المبايعة؟ أو قام المشتري بنقلها أو إعادة بيعها إلى مشترٍ آخر؟

Is the creditor obliged to provide a proof of funds for the debtor to issue an arrest order?
Q: I recently made a petition to issue a subpoena arrest order on the debtor in my execution case. The honorable court rejected my petition.
I was then told that there is a new ruling that the creditor has to prove that the debtor has funds while submitting a subpoena request.
A) Is the above new requirement true? Is it not sufficient to prove that the debtor has not paid?
B) The debtor made a power of attorney in the name of her brother, giving him the power to collect all funds that are payable to the debtor.
In this way, the debtor's bank account shows zero, but she can get a supplementary credit card from her brother, and pay for all purchases.
What can I do?
C) What methods are available to me to detect the funds of the debtor, or to prove that she is using methods to hide her funds?

How to enforce a judgment agaisnt a debtor who fled the country to get the outstanding payment?
Q: Reference to the defendant's non-payment of execution writ. Seven years ago I won a case and the court obliged the defendant to pay.
At the time, the court failed to approve the arrest warrant and the defendant ran away. Now, all the necessary requests are approved in the system but the court is unable to find the defendant.
What are my rights in this situation to get the outstanding payment either from the defendant or his family and friends?

How can I proceed with auctioning my employer's seized vehicles after court authorization?
Q: Hello,
My case is under execution. Two months ago, I blocked my employer’s traffic file with the RTA, but he still hasn’t paid me. Using the traffic file number, I found nine vehicles registered in his name on the Dubai Police website.
I requested the court to auction these cars, and the court approved, but Emirates Auctions stated that the cars have not yet been seized, valued, or notified.
The court then stated: "Postponing the sale procedures until the seizure and announcement of the vehicles are executed."
I requested the cars to be seized, and the court authorized it: "Authorization is granted to seize the vehicles as per the request and police report."
What should I do now? Also, does “seizure” mean the cars can’t be driven?

Cleaner's resignation with 30-day notice in incomplete contract
Hello,
Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية. هل يجوز ذلك؟
السلام عليكم،
هل يحق للبنك في إمارة دبي أن يرفع دعوى جنائية أو مدنية ضد عميل لم يسدد مبالغ الفائدة بل سدد فقط المبالغ التي قدمها البنك أصليًا (مبلغ القرض فقط)؟
منحه البنك بطاقة ائتمانية بحجة أنه "قرض حسن بدون فوائد"، وبعدما استخدم العميل البطاقة الائتمانية بفترة زمنية قصيرة وفجأةً تم إرسال رسالة إلى العميل تفيد بأن هناك مبالغ متراكمة بسبب الفائدة البنكية بقيمة ٤٠٪ من القرض الأساس المُقدم إليه.
علمًا بأنه تم تزويد العميل بالبطاقة الائتمانية عن طريق البريد السريع لعنوان منزله بدون طلب رسمي من العميل بذلك، بالإضافة إلى أنه لا يوجد أي من المستندات التالية بين البنك والعميل:
١- عقد. ٢- اتفاقية. ٣- شيكات كضمان. ٤- سند أو شريعة أو قبول خطي أو غير خطي أو توثيق يتضمن أي توقيع من الأطراف؛ بمعنى آخر، لا يوجد أي اتفاق على الإطلاق.
العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية المضافة سالفة الذكر.
