How to agree on the applicable law for divorce if the couple seek different laws
Hi,
I had a question regarding starting divorce proceedings in Dubai. My wife and I are Australian citizens, Dubai residents.
We are originally from India, married in India as per Hindu customs. We have two kids (23 years & 14 years) both Australian passports also.
She wants to apply the UAE law for the divorce and I want to proceed as per Australian law. Can you advise how the court will rule and which country law should apply?

If both parties agree to apply the law of their country, then that law will be applicable.
But since your wife does not consent to apply the law of her country, then in such case, Sharia/UAE law will apply.

If you wish to apply Australian law then you can do so as the UAE law applies the law of the nationality of the husband on divorce matters.
However, you will need to provide an endorsed officially translated copy of the Australian law to the courts so for it to apply to your divorce.
