Seeking the application of American law in a divorce case

My husband and I are both Americans. He wants to divorce in Abu Dhabi, but I don’t want to divorce in here because he is going to leave after divorce.

We have been married for 16 years and have a 14-year-old and 12-year-old boys. I want to divorce in America and he wants me to sign the divorce paper.

So, do I have the right to reject divorce in the UAE and only accept it in America?

Dear questioner,

You have two choices regarding your matter:

1- You can leave the UAE to your home country, and you can file there a divorce case.

2- In case you did not leave the UAE, you can ask Abu Dhabi court for enforcing the USA law.

He can divorce you here if he will move to the court, but you can ask the court for your American law to apply.

For your interest, the best option is to file a divorce petition in America and show to the UAE court that your matter is already going on in some other court.
