إلغاء تأشيرة الموظف من جانب صاحب العمل دون تسوية مستحقاته
مرحبًا سيدي،
لقد عملت لدى إحدى الشركات لمدة أربع سنوات وأربعة أشهر بموجب عقد عمل غير محدد المدة واستقلت بعد فترة إشعار مدتها شهر واحد لأن صاحب العمل لم يدفع لي الراتب كما ينبغي لمدة عام تقريبًا.
الآن، لم يقم بتسوية مستحقات نهاية الخدمة أو الرواتب المعلقة المستحقة لي، لكنه ألغى التأشيرة.
كيف يمكنني المطالبة بمستحقاتي؟

We are a law firm working in the UAE since 2008 and we are pleased to assist you on this UAE labor law matter.
Referring to your questions, it seems that, by not paying you the salary for one year even on an irregular basis, it constitutes a UAE labor law of 1980 violation.
It would have been the best scenario if you had filed a formal complaint with the ministry of Labor [Ministry of human resources] in the UAE to settle this issue at that time.
However, albeit, we had not reviewed your employment contract, but keeping in mind the above facts mentioned by you, the employer is violating the law and you can claim your pending salary and end of the term benefits as well.
