How to act against the employer for the non-payment of salaries

Hi Dear Sir or Madam!

My company visa is about to expire in the month of July and my ten months salary is in pending the owner says today and tomorrow I will be giving it to you.

So what should I do if the owner asks me to sign the cancellation and I never want?

Will I pay the overstay charges or my employer will pay the fine?
