Q: I started working in August 2017 with a company in Dubai. By the end of August, I received my first salary on time.
Now, it is already the end of October and my employer still didn't pay my September salary. As per accounting, it is also not clear when we will receive October salary, maybe mid of November for September salary only.
My contract is unlimited and I would like to know when I can report salary delay to the MoL. By 11.11.2017, will my contract be breached because of 2 unpaid salaries in a row, and can I resign and change to a new company without getting a labour ban?
When can I stop working for my current company without notice due to unpaid salary and breach of contract?

Labour proceedings for the non-payment of salary

Q: Hi
I have been working in the UAE since Feb 2017 and I left my job on 31st July 2018 due to unpaid salary. I am on a free zone visa, valid until 2020 (Tecom: Academic City).
Still, my one salary is pending and I also have not taken my yearly one month paid vacation for 2017 (as included in my contract). Now, the company wants to cancel my visa.
I just want to know if they can cancel my visa without my signature.
And am I entitled to receive one salary for my paid vacation that I did not take?
Where should I go to file the complaint?

Forcing an employee to accept cancellation without any dues
2
Q: Dear Ms Khan,
I signed a job offer on Nov 2017 and worked for 2 years. The labour card & visa expired on 27 Nov 2019. The employer did not renew/cancel/pay salary from Nov. On 5 Jan 2020, I resigned.
On 6 Jan 2020, the HR manager acknowledged the receipt of my resignation. I filed a complaint with MOHRE. The employer attended the meeting and accepted my resignation without notice period.
He also agreed to verify and settle DUES within 3 days. MOHRE closed my complaint.
Now, the employer's legal counsel is threatening to file a case and contest on grounds of Breach of Contract & Conflict of Interest. They are forcing me to accept cancellation without any dues.
My questions are:
1: Are the employer's actions legal?
2: Can I re-open my MOHRE complaint? If the Employer is not agreeing to MOHRE mediation and goes to court. What is the prescribed time frame to resolve the case?
3: Because my visa and EID have expired, I am not able to travel or even get medical treatment for myself. What are my options?
Thanks!

Recovering the pending dues from the employer after canceling the visa?

Q: Hello,
I am working for a company in Al Hamriyah Freezone for the last 7 years. I have a pending 13-month salary, gratuity, and leave salary.
My contract is going to expire within 4 months. And I have an offer to join another company within 1 month. The current company is saying excuses that they will not be able to pay that much amount.
Also, I would like to join another company. How could I recover the pending dues from the company even after canceling the visa?

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property 1
Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.

Absent repeatedly due to salary delays. Can the company terminate them without EOSB? 1
Dear Sir/Madam,
There is an employee who has been absent repeatedly. However, the company is not paying salaries on time, with regular delays in salary payments.
Can the company terminate the employee without end-of-service or notice period compensation if the employee cites occasional salary delays as the reason for their absences?

How is the probation period calculated exactly from the date of signing the contract? 0
Regarding the probation period, when is the deadline for an employer to terminate me if the DOJ anniversary is Friday 2nd Feb?
Will the six-month period end at midnight on the 1st, therefore completing six months, or can the employer still terminate on the 2nd?
Appreciate any guidance provided.
