Q: Hello Ma'am,
I just want to ask for advice, as my employer just recently terminated me under a limited contract.
I was hired July 2, 2017, and last Wednesday, Sept 20, 2017, the newly hired HR and General Manager spoke with me that they will no more continue my contract with them.
They are claiming that I have made delays which I'm not aware of, and they didn't send me any warnings through email.
I have filed one-day sick leave when I was not really feeling well. Immediately on that day, they gave me a cheque which I served for 20 days only.
They just told me without any notice period, and haven't informed me or warned me if I have committed mistakes with their policies. Is this right?

What is included in the end of service gratuity?

Q: Good day,
My end of service date was indicated.
I was told that my end-of-service gratuity will be compared vs. annual bonus payments during my employment and since my start of service to see from which I have received the most benefit.
How legitimate is this in accordance with the UAE Law?
Any bonus payments over the years and the end-of-service gratuity is free-standing, correct?

Refusing admission to a French school due to the nationality of the child

Q: Hello,
My child has been refused admission to a French school in Dubai, two years in a row, in Pre-KG (first-class) where all nationalities can apply, because he is a Saudi citizen and the school gives priority to French and Emirates citizens.
The director clearly says it is based on nationality because this year we were amongst the first ones to apply.
The UAE government does not differentiate between UAE citizens and GCC citizens (Saudis) giving them free education in public schools to be non-discriminatory between locals and GCC citizens.
KHDA regulating private schools can speak to the school but cannot enforce the admission because it is the school's internal policy.
How is it possible to be bluntly discriminated against two years in a row? Can we legally sue the school for being discriminatory and also can an internal policy be contradictory to government laws/constitutional laws etc?

Q: Hello,
I got a termination in my probation period but I have a notice period of 1 month in the termination letter.
Yesterday, I got one interview with the permission of the manager I went for an interview for 2 and a half hours.
Then the MD shouted at me and said not to come from tomorrow onwards to the office as they do not allow me to complete my notice period.
They sent the mail also to me not to come to the office and come in the evening to collect my dues. I sent the reply mail that I cannot come for your yesterdays mental and verbal harassing conversations.
And I request to send my detailed settlements for further process through the mail, but they didn't reply to me and I am afraid they will not pay.
They're also saying to me they will pay until worked days on probation but my notice clearly mentioned they will pay in full in the period of the last.
Please tell me if I am in trouble.

How can I claim unpaid salary and unused leave days held by employer after resignation?

Q: I joined an organization on 22nd March and decided to resign on 14 July with the intention to stay in the country and apply for another job.
Based on the UAE labor law, I gave a notice period of one month. However, I was asked to work for 14 days from 14 July which means my last day will be 27th July.
They are not ready to pay me for the rest of my notice period which I am happy to work through. I also accrued 8 days of annual leave during this period, as I haven't utilized it.
Do I get annual leave encashment?
What options do I have if they disagree?

Q: My employer sent me an email of termination and told me I don't need to attend the notice period (1 month).
Does that legally spare him from paying me the full salary disclosed in the contract for my notice period?
If not, how do I get evidence from the labor ministry that I haven't been paid for my notice month when I submit a complaint?

Can I send a cease and desist letter to a teacher at my school?
She does not teach any of my subjects, but I want her to stop approaching me and talking to me entirely. I have tried addressing this through the school, but the teacher continues to make snarky remarks or comments about my outfits.
Also, what happens if she continues to communicate with me despite the cease and desist?

We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day.
We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds."
We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it.

Hello,
I want to inquire regarding my leave privileges. I am now 11 months in my company. How many leaves am I privileged to?
Based on Decree-Law No. 33 of 2021 regulating labour relations and its executive regulations, you are entitled to a paid weekly rest for not less than one day, as specified in the work contract or the work regulation.
The Council of Ministers may increase the weekly rest day stipulated in this article. The Decree-Law and its executive regulations also stipulate that you are entitled to an annual leave with full pay as follows:
- Thirty days for each year of your extended service.
- Two days per month in respect of any employee with more than six months and less than one year of service.
- Leave for parts of the last year of your service in case it is terminated before you use your annual leave balance.
Now my question is: do I have 22 days I can use? Can someone explain to me in detail?

What can I do if I got a judgment in absentia for selling medicine without a license? 0
I got an order of 6 months imprisonment and deportation for a judgment in absentia by the Sharjah court for selling medicine without a license. I was not involved in the case directly; my friend used my car, and he had my bank card.
They made a confession that they were working for me and made a false claim that they had transferred money to me. As I am outside the country, I came to the UAE to solve my case.
I got detained at the airport, and the CID asked me some questions. I mentioned they didn’t transfer me a single Dihram, so he let me go, as the case was already open for appeal.
In the first instance court, they gave me the same verdict, then I appealed and attached documents like bank statements and my company details, which were not mentioned before.
They gave a date for the judgment, but it was not issued, and they gave the next date. I have been suffering a lot for the last 3 months here in the UAE and for 6 months back home.
So my question is that what will happen next?
Will the case be open for retrial, and will the CID be convinced by my logic?
Can they drop charges, or now the court decide only?

A company is registered in a free zone (Dubai South) and had 4 shareholders.
But now one of them passed away and the successor is a very old lady, who is not cooperative and will not be able to sign any document at all (and she lives in another country).
We have no idea who will be a successor after this old lady and these people will in fact never be interested to do anything with this company.
The company is financed and managed by only one shareholder, who is willing to continue.
