The right of infants custody if the mother seeks to get a divorce

Hello.

If I applied for Khula'a, will I lose the custody of my children?

I am a foreigner married to a UAE national. I have 2 months old baby and 1.4 months old daughter.

No, you can claim custody as we suppose these are feeding children and should be beside their mother.

It should be enough reason.

Yes, it's possible for you to file Khula, however, it doesn't affect the custody of the children.

The only thing that you will not get is whatever he bought that has been given by your husband before marriage, after marriage or during the marriage, will have to be returned back to him.

Hiba means dowry or any gifts that he has provided, you should give back to him but custody of children is for you.
