Giving child custody to father in case of divorce

Hi,

In the case of divorce, child custody will go to who?

I am the mother and my baby is 5 months old. Is there a chance that the child will be given to the father?

And what are the reasons if the child will be given to the father and not the mother?

Hello,

Generally speaking, in the U.A.E., custody is given to the mother, especially if the child is a minor. The father, however, will have guardianship over the child.

There are cases where the father is given custody of the child, but this depends more on the background of your specific matter.

For example, this may occur if the judge does not deem the mother fit to have custody of the child, if the mother does not want custody of the child, or if the mother is no longer alive.
