Q: Hello,
I hope all is well.
I have an events company and a supplier has given me a quotation for a wedding free of charge with a design without asking for charges.
The wedding had a lot of planning hiccups so it was dragged along but I promised to try to give it to him if it’s possible but had not confirmed either verbally or on a signed agreement.
And till 2 weeks ago I told him I will need to use a local supplier rather than him but if I needed more equipment I would tell him and he replied by saying please do send me a list if u require anything.
However, there is no signed agreement and the quotation was for 1.7 million dollars and there’s no agreement with him and the wedding is November 8-9, so I am sure he knew he wasn’t getting it.
Is he allowed to file a case based on nothing written and signed because we all know no supplier works on anything without signed contract and deposit and that’s in every contract?

Breaching contract by the service provider and possible action

Q: Compensation for poor performance & false accusations.
We hired a consultancy agency to provide us with their services. During our working relationship, the deliveries were consistently late, and the service was unreliable.
We gave them numerous chances to improve performance and meet timelines.
The details of these problems have been communicated to them repeatedly but they did not address the problems in a timely manner, causing us extra expenses in addition to mental and emotional agony.
During the project, my father passed away & they have used this matter as an excuse to pause work on the project without notifying us causing us further delays.
Recently, we serviced them a notice for contract termination for their failure to adhere to mentioned services.
In response, they have wrongfully accused me of talking badly about their staff & making insulting & inappropriate comments about their work which have made the working relationship difficult.
Do we have legal rights to pursue?

Requiring a replacement of the material of a project by a client after written approval

Q: We are a startup. We had been awarded a project of x value from a client.
The client specified the material to be used for a project and to provide a competitive quote, which we did after contacting the supplier. We got the deal done for a really good price and bagged the project.
After the LPO award, we started with the execution and did a mockup (completed 15% of work). After taking the client’s approval again in writing, we went ahead & placed the order.
It’s been 3 months and still, the client hasn’t made any payments, now they are saying that the material is wrong. They want a replacement.
The supplier has shipped the material to the warehouse in UAE since 3 months and we have paid 40% to the supplier. The supplier has paid 100% to the manufacturer, we have issued the supplier an LPO.
Now, the supplier has warned us about taking legal action against us.
The client we are dealing with is a big client, how can we take this further?
Can we claim the legal fees in court?

Asking for full refund upon failing to fulfil obligations by a manufacturer

Q: Hello,
I am looking for legal advice regarding the following case:
I ordered from a clothing manufacturer several custom-made items (T-shirts, sweaters, etc.). While customizing the items before production, I was offered different fabrics and ended up choosing one which was presented to me as 100% cotton.
The items were made and the manufacturer put labels on each and every piece indicating they are 100% cotton.
Recently, someone brought to my attention that these fabrics were not 100% cotton. I asked the manufacturer to provide a certificate saying that they are and he refused, coming up with some excuses.
So I paid for a test myself and the results showed that indeed these fabrics are not 100% cotton. This puts me in a very bad position as I plan to sell these items, which I can't do now as I will be lying to my clients.
What can/should I do now? Can I ask for a full refund?

What can we do if the courier company failed to deliver all the goods we ordered?

Q: Our Issue is with the courier company. We have an account with that courier company.
We had recently booked the courier to pick goods from France and deliver them to our shop in Dubai.
So it was total of 50 carton (200pcs) which they had to pick and deliver to us. They picked 50 cartons but delivered only 47 cartons.
And now they don't know where those cartons are and because of that, we are facing issues with our customer.
When we call the courier they are not replying and when we email them they are telling us that they are investigating. But still there has been no result of the investigation.
So please advise what is the procedure to move with this.

I bought a brand new car in March this year. Unfortunately, we had a serious accident resulting in a total wreck of the car.
We noticed that airbags didn't deploy at all even after the car turned upside down.
Can we sue the car manufacturer?

A forwarder on a Free on Board (FOB) basis is not sharing a copy of the Bill of Lading (BL) and exit point with us despite multiple follow-ups.
What can we do about this?
We need this copy for audit purposes.

When I went to the free zone to cancel my visa and close the company, they have asked me to get his attested death certificate and NOC from his heirs.
The problem I am facing is his family doesn’t want to give the death certificate nor they want to give NOC. Now my resident visa validity is over and I am on fine every day.
Neither the free zone is cooperating nor the partner's family. What is the other way I can cancel my visa and close the company?

How the objection of a client be dealt with after being notified for termination by DLD? 0
I have been notified by DLD that I am in breach of an off-plan sales agreement, and the developer wishes to terminate the agreement.
The date on the notice is March 9, 2021, and I received it from the developer on March 11, 2021. The notice says I have 30 days "from the date of being notified" to make the outstanding payment.
On the termination notice from DLD, a list of objections is present. One of the objections states that the developer must hand over the final SPA to me.
In this case, I have not received the final SPA from the developer. I made an objection in writing to the DLD pointing this fact out and sent it via email, and received a confirmation of the same from DLD by return e-mail on April 6, 2021.
30 days from March 9th is April 8th, or from March 11th is April 10th. Does the developer have to respond to my objection before the DLD will allow them to terminate the agreement?
In this case, will the time I have to make the payment be extended by any period?

Closing a business while the local service agent is not reachable 0
Hi,
We have a professional services license (2 partners) + 1 local service agent registered with DED, Dubai.
The partners wish to close the business because of unavoidable circumstances. We wish to proceed with all the necessary paperwork for cancellation.
Unfortunately, the local service agent is not available. We have been trying to connect to him multiple times but have not been able to reach him.
The due date for the renewal of the company is coming up and we want to proceed with all the paperwork for cancellation prior to that.

Returning to the UAE to run business after being convicted with a crime 0
Hi,
I want some information regarding my uncle. He was arrested in November 2015 and was in prison until 13 June 2016 when he was deported to Pakistan.
The reason for the arrest was that my uncle had his own business in Sharjah and he was involved in a case where his employee accused him of attacking him and other allegations. He was arrested and convicted.
He needs to reenter the country as he has his business in Sharjah but I believe he is blacklisted/banned. How can I find out if he is blacklisted/banned and how can it be removed to allow my uncle to reenter the country and take over his business?
Is there any way of helping to resolve this issue?
I know that if he enters on a visa, he could be arrested at the airport, and don’t want that to happen.
