Are consultants of a UAE company working remotely claim rights other than salary?

Hi,

I hope you are well.

I wanted to ask that if we hire employees from another country as consultants and they work remotely from that country for a company based in the UAE, will they be eligible for any perks other than the salary/consultation fee?

In general, the answer to this question is "No", however, under certain circumstances they can claim to be employees and that they deserve perks other than the consultation fee.

Therefore, working with "consultants" outside the UAE should be done in a very specific way to avoid having them confused as employees and to avoid the risk of them raising legal action before the UAE courts to ask for benefits/perks.

As a legal consultancy firm regulated in the UAE, the law mandates that I must onboard every client where legal advice is offered.
