Right of the employee to seek compensation when terminated after probation

Hi,

My employer asked me to sign a dismissal of service due to a lack of projects.

I have been working there for more than 6 months and I was planning to go back to my home country after my notice period.

Am I entitled to compensation due to dismissal of service by just working for more than 6 months?

Dear Questioner,

Thanks for contacting me.

I understand that your employer has made you redundant after you worked for him for a continuous period of six months.

Please note that 6 months is the maximum period of probation as per Article 37 of the UAE labour law. Hence I assume that you have already completed your probation period.

In that case, you are eligible for arbitrary termination compensation since redundancy is not a valid reason as per the UAE labour law.

Please note that your employer has the right to terminate you without assigning a reason and notice during the probation or at the end of the probation period [Article 120, UAE labour law].

However, since your employer has mentioned the reason for termination redundancy, you can seek remedy against your employer's decision.
