س: ربحت قضية عمالية وفتحت ملف تنفيذي. أُعلِن المُدَّعَى عليه في الشركة عن طريق لصق الإعلان. ما المدة المُتوقَّعة لإنهاء القضية؟ هل يستطيع عمل استئناف نظرًا لأن الحكم حضوري اعتباري وأنه لم يُستدَل عليه لإعلانه بحكم المحكمة؟

Q: Hi there, I have won the labour case against my employer with an amount of AED 75,000, regarding salaries issue. Now, my company has filed an appeal request to appeal the court judgment. My question is, how much time will Dubai appeal court take? What documents do I have to provide? Can I claim more amount due to the waste of time or having no job? Please reply to me. Best regards

س: رفعت قضية عمالية ضد شركتي وصدر الحكم لصالحي بتاريخ 23/03/2021. قدَّم محامي الشركة المُدَّعَى عليها ضمن قضية الاستئناف طلبًا بتاريخ 15/04/2021 وأُلغي بتاريخ 21/04/2021 بسبب عدم المراجعة ضمن المدة المُحددة ثم قدّم طلبًا ثانيًا بتاريخ 01/05/2021 وحالة الطلب حاليًا قيد المراجعة. السؤال: هل يمكن الاستمرار بتقديم طلبات إلى ما لا نهاية أم أن الطلب الثاني يعتبر خارج المدة المسموح بها للاستئناف؟

س: السلام عليكم ورحمة الله وبركاته، عملت بشركة للنقل والمقاولات بأبوظبي لمدة 14 عامًا. منذ سنة ونصف تركت العمل بسبب تأخُّر ست رواتب ورفعت قضية ضد الشركة وربحتها ووضعت الحكم في التنفيذ. حجزنا عليهم وحررنا طلبات ضبط وإحضار ولكن بدون فائدة. منذ حوالي ثلاثة أشهر حولت المحكمة القضايا إلى قضية جماعية لأكثر من 200 شخص وإلى الآن لم نستفد شيء. الحجوزات موجودة والشركة ذات مسؤولية محدودة وهي تعمل وتأتيها دفعات لكن للأسف الدفعات لا تنزل في حسابات الشركة المعروفة لدى المحكمة. انتهت إقامتي وأنا مخالف ولم أجد عمل منذ أكثر من سنة وضاقت الأحوال. كلما اتصلت بالمحكمة يخبروني أنهم نفذوا الإجراءات ولا توجد أموال في الملف التنفيذي. ماذا بعد كل هذا؟ نحن عالقون بالبلد والشركة لا تبالي! إلى متى الانتظار؟ وشكرًا!

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
