Renewing the residence visa and business license while civil and criminal cases are pending

I filed a civil case against a businesswoman in Dubai due to a bounced cheque.

There is judgment already and I filed execution as well. Will she be able to renew her residence visa and business license if there are pending civil and criminal cases against her?

It is a single proprietorship business owned by her.

Hi questioner,

Yes, she will be prevented from renewing her residence visa, since it is a personal cheque, however, she can do this by paying the cheque penalty and obtaining a clearance letter.

In regards to the civil case, she can renew her residence visa anytime, unless she has an arrest warrant from the execution department.

Hi,

Thanks for ur reply!

She issued a cheque drawn against her business account, but she is the sole signatory. Shall I still apply in court to stop her from renewing her residence visa?

If there is a warrant of arrest, will she be forced to pay the execution amount to avoid being jailed?

Many thanks!

Hi,

How much is the cheque amount?

However, once she closes the criminal case and is issued a clearance letter, she can renew her visa.

Civil execution will not prevent her from renewing her visa.

Hi,

The amount of the cheque is AED50,000.

If I apply for a warrant of arrest, will they put her in jail, and for how long. Is her liability with me gets cleared once she finishes her jail time?
