Drawing up a pre-nuptial agreement in the UAE

I'm looking for help on how to draw up a pre-nuptial agreement.

I am a UK citizen, resident in the UAE. My wife-to-be is from Brazil. We have assets (individually owned) in several countries and a business we co-own in the UK and are setting up a further business in the UAE.

Our marriage will be officiated in the USA, just to complicate things further!

What country should the pre-nuptial agreement be drawn up in?

Can it be done in the UK as we both will live here?

Dear Client,

Good day!

It is not allowed as per Sharia for the pre-nuptial agreement.

However, because of the new change in Law, things are not clear yet for us to understand whether the pre-nuptial agreement can be enforced unless we see a judgment to that effect.

I would strongly recommend you to draft a pre-nuptial agreement, take it to the UK, get it stamped, get it signed, and you can do the notarization procedures: Notary Public, Ministry of Foreign Affairs & UAE Embassy and you can keep it with you.

This is as good as it's been done in the UAE, however, in the UK Jurisdiction, pre-nuptials are held well in law.

For further assistance, please feel free to contact us via phone or email.

Thank you!
