How to lift a labour ban imposed for early exit from a limited contract

Hi Madam,

I have got a one-year labour ban from MOHRE due to the non-completion of the notice period in a limited contract.

Now, I have received a new job offer from another company with a better placement and salary package.

Please advise me about the possibilities of lifting my labour ban.

Dear Questioner,

I understand that the one-year labour ban was imposed by the ministry directly for terminating the limited contract.

The same applies to you from the date of exiting the country. A labour ban is lifted automatically after the lapse of the ban period imposed by MoHRE.

Since such a ban is imposed on the basis of the violation of public policy, the same cannot be compromised.

The exceptions were given under Article 4 of the Ministerial Resolution No.1186 of 2010, that allows the Ministry to issue a work permit to the employee, if the employee is starting his new position at the first, second or third professional levels and provided his new wage is not less than AED 12,000 at the first professional level, AED 7,000 at the second professional level and 5,000 at the third professional level.

But, the above-mentioned Resolution [Ministerial Resolution No.1186 for 2010] was nullified by the Ministerial Decree No. (766) OF 2015.
