س: مساء الخير،
توجد ضدي قضية جزائية "تهمة خيانة أمانة" وأثبت الخبير المحاسبي المُعيّن من المحكمة أن الشركة لم تقدِّم دليلاً على أن المتهم اختلس أي مبالغ مالية.
حصلت على حكم ابتدائي بالسجن والغرامة، واستأنفت الحكم فتم تخفيضه إلى 20 ألف وقدمت على طعن، ولكن رُفض الطعن.
هل توجد أي حلول أخرى لإثبات برائتي أو تقديم التماس أو إعادة نظر؟

Q: Hi there,
I have won the labour case against my employer with an amount of AED 75,000, regarding salaries issue. Now, my company has filed an appeal request to appeal the court judgment.
My question is, how much time will Dubai appeal court take? What documents do I have to provide? Can I claim more amount due to the waste of time or having no job?

Labor case judgement execution

Q: A labour case was ruled in my favour and I received the judgement at the end of 2016. The judgement progressed to execution and not One Dirham has been paid by my ex-employer to date.
We have spent the last year searching assets in all banks, combined with real estate, RTA etc. and all have come back with no assets. An attachment was made on the office assets, shortly after the Rental Dispute Committee issued a Judgement awarding the office assets to the Landlord.
Finally, we located a valid Bank Guarantee held with a Government Authority. But the entity is not cooperating.
As per Federal Law No. 8 for 1980 On Regulation of Labour Relations, Article 4 gives priority over all assets.
However, in this scenario, Federal Labour Law, Dubai Real Estate Laws and further laws are all overlapping and conflicting.
My query is, is there a document or law that states which law has priority over another to help resolve the issues I am facing with the judgement execution?

س: وقَّعت على ٣ إيصالات أمانة على بياض باعتبارها مسوغات تعيين. كان ذلك شرطًا من صاحب العمل وأنا كتبت الاسم ورقم البطاقة والاسم تحت ولكن لم أكتب شيئًا في التوقيع وبصمت عليهم.
حدثت مشكلة وهددني بهم وقدم شكوى ضدي. حررت محضر إثبات حالة ومعي شهود أنني وقعت عليه باعتباره مسوغات تعيين.
ماذا أفعل؟
مع العلم أنه صدرت ضدي أحكام غيابية؟ ما الحل؟
قدم شكوى عن إيصالين باسمه وأخرى عن الإيصال الثالث باسم آخر.

مقاضاة شخص اتصل بآخر وهدده اعتمادًا على وظيفته

س: السلام عليكم،
بناءً على مشكلة مع شخص معرفة، تلقيت اتصالاً من كفيل الشخص (حسب ادعائه ومع ذكر اسمه) طالبًا معرفة طبيعة المشكلة والطلبات لحلها ولكن لم نصل لنتيجة منصفة، وبناءً عليه أشار المتصل بأنه يعمل بدائرة التحري وأنه يعلم بمكان إقامتي وباستطاعته إحضاري.
علمًا بأن المتصل ليس الكفيل الحالي حسبما أفاد، وهو يعمل فعليًا بدائرة التحري. الاتصال صادر من هاتف محمول. لا توجد أي قضية ضدي أو أمر ضبط أو تعميم.
كيف يمكن مقاضاة هذا المتصل؟ وهل يمكن مطالبة النيابة بتحصيل تسجيل المكالمة من شركة الاتصالات المعنية باعتبار ذلك دليلاً؟

اليوم في الجلسة القاضي قال انتظر القرار غدًا على النظام.
هل يقصد بذلك الحكم النهائي؟ وما النظام المقصود؟
إذا حكم لي في القضية براتبي المتأخر (٣ أشهر)، فما المدة حتى آخذ راتبي من المُدَّعَى عليه؟

What can I do if my tenant is not providing rent cheques nor responding to renew the tenancy contract? 0
Hi,
I am a landlord and need advice on the following scenario.
- The contract with my tenant expired in Sep 2024. Upon requesting the renewal, the tenant mentioned that she is out of the country and will sign the renewal contract and provide the rent checks. In the meantime, she paid the first quarter of rent through a bank transfer.
- After 3 months, when the next quarter's payment was due, she deposited the next quarter's rent into my bank but did not sign the contract renewal despite my follow-up with her multiple times. At this time, she had returned to Dubai.
- Now the next quarter payment is due, however, the tenant is not responding to WhatsApp or answering calls. She is NOT paying rent or renewing the contract.
What action can I take since she is not answering my calls or messages?
She does not have a valid contract or Ejari, and her rent is delayed by 1 month. All WhatsApp messages are delivered, but she chooses not to respond.
