Q: Hello,
I'm an owner of an apartment in Dubai and my tenant is not paying rent.
I have submitted the legal notice with the notary public and it's already due, until now, the tenant is saying that he will pay.
I have one problem, the tenant is a male and I think he is out of the country, but all negotiations are with his wife and the cheque is given by his company.
How can I evict them from my property?
Please help.

Q: Hi
I am a Landlord; the tenant has not paid rent for 4 months and he is refusing to leave.
The tenant says he was never given a contract nor Ejari and the tenant gave me a cheque which was not valid due to the account being closed. He was supposed to bring a new chequebook but never did.
I opened a case regarding bounced cheque and a notice of eviction last month but the tenant never left the house.
My question is, can I bring the case to the court even if I never issued an Ejari nor a legal contract?
Kindly advise because I don’t know what to do at this point.

Q: Hi,
I have an apartment in Dubai rented out to a tenant since Mar 2020.
I have been a very supportive landlord in the COVID-19 situation, have collected monthly rents in cash instead of depositing the cheque even delayed the rent for a couple of months, and reduced the rent for July 2020.
For the last rent cheque which is due next week Jan 10th 2021, the tenant has asked me not to put the cheque and still requesting for negotiation.
The tenant lost his job in April but was successfully running his own business on an extended residency visa from his company. His visa is cancelled now and says that accounts are frozen, and not to put the cheque.
When I asked for cash payment he said there is no money. Can I still choose to deposit the cheque and proceed legally?
Or Should I give him a one month notice? Do I still need to wait for his green light to put the cheque?
I feel the tenant is taking undue advantage of me being nice since it has happened every month since April.
Please advise.

How to evict a tenant and recover the cost of overstay?

Q: Hi,
Our tenant has been violating the terms of the contract right from the beginning by:
a) Not transferring one utility connection under his name causing us to continue incurring charges,
b) Keeping a pet which is against community rules. We have repeatedly received complaints from neighbors and building management regarding the disturbance caused by his pet.
We have issued the tenant numerous warnings but all in vain. At the end of one year contract, we negotiated and the tenant agreed to vacate after 3 months (signed 3 months contract).
Now after the end of 3 months tenure, he is not vacating and we are not willing to renew the contract considering the distress he has caused us and the neighbors by going against the terms of the contract.
What is the legal recourse to evict him? We understand that the first step is to send 30 days' legal notice but what beyond that?
Also, how to recover the cost of over-stay as the deposit would not be sufficient to even cover the utility expenses?
We are not based in Dubai.

Q: Dear sir/madam,
My rental cheque is due tomorrow and unfortunately, I’m not able to honor it. I asked my landlord to wait a couple of days but he doesn’t want to wait and said that he is going to cash the cheque tomorrow.
Of course, the cheque will bounce, what would be the procedure then?
Do I have a certain amount of days before eviction to pay the rent?

Q: Dear Lawyers,
I rented my apartment to a tenant. Before they moved in, they mentioned having a money issue and agreed to pay one month's rent first. They said they would pay the deposit and the next month's rent the following month.
They also agreed to sign one open cheque for the deposit and one cheque for each month’s rent.
In the one month they stayed, I received three notifications from the management team regarding violations of building rules, such as putting decorations on the door.
At the end of the month, the cheque bounced due to signature issues, which implies that all the cheques cannot be deposited. I have tried to contact them, but they do not respond.
I realize this could become a serious problem. What can I do now to reduce my loss and evict them?

The company has been contacting the employer, urging them to ask my colleague to get in touch with them regarding a supposed liability.
This claim is related to a 15-year-old closed dispute with a bank credit card, and the issue seems to stem from outdated and inaccurate information on the AECB report.
Our main concerns are as follows:
Unauthorized Access: The company is accessing her AECB report without her consent. She has never given permission for them to retrieve or view her personal financial information.
How is it possible for a third-party agency to openly access and track AECB reports, especially for a dispute that was resolved 15 years ago?

I was evicted from my apartment to be sold but it was gifted and rented at a higher price. What can I do? 0
I was evicted from my apartment after living there for five years. My landlord informed me a year in advance that the lease would not be renewed because he intended to sell the property.
Prior to this, he attempted to impose a rent increase that was not compliant with RERA regulations, which I refused to accept. He then served me with an official Dubai Court eviction notice, citing the need to take back the property for sale.
Five months after I moved out, I discovered the property was rented out at a much higher price. Upon further investigation, I found that the ownership was transferred as a "Gift" rather than a sale.
This makes it seem like the eviction was only to raise the rent rather than a genuine need to sell.
Do I have a valid case for wrongful eviction against my landlord?
Also, under Dubai law, does transferring ownership as a "Gift" hold the same legal grounds as selling in justifying eviction?

Hi
I'm an Irish citizen and a resident of the United Kingdom. I got investment fraud in Dubai. I invested money into a business with a Pakistani national guy in March 2024 via bank transfer into his business account.
Now he's giving back the money which I invested in business after 9 months. He's preparing a letter from a local lawyer to kick me out of the business. I do not have any other option than to take out at least my money.
But it's unfair to me that he used my money in business and took all the advantage.
Some people say to me that if you claim money or take legal action against him, it will take too much time and I need to travel to Dubai to appear in court because it is a civil matter. But I'm not a resident.
How can I follow the civil case there?
That's why my partner knows that I can not do anything and this case keeps running long time and in the end nothing happens. But I'm thinking that I will submit a complaint through my embassy and I also have a solicitor in the United Kingdom.

Even though the old owner gave the tenant a 90-day notice about the new rent, the tenant is not agreeing to the notice because it didn't come from us.
Since the renewal is in October and we bought the property in September, we don't have 90 days to notify the tenant of the new rent.
The tenant agreed to the new rent in an email with the old owner 90 days ago. Can we dispute this?

What can I do if a company hired me then changed their mind? 0

X Real Estate LLC is a newly formed LLC company in the mainland (DED) with 10 partners, 9 of them Indians and one Pakistani.
As per the new provisions, the company is owned 100 % by expatriate residents. The company’s business is buying and selling real estate in the UAE.
Query:
What happens to the company and other partners, when one partner dies with or without a will?
Can the remaining partners continue to operate the bank account or it will be frozen?
Are the operations of the company frozen? Can the remaining partners carry on the business as usual, buy, rent, and sell the properties?
Can the partners pay the share of the deceased partner to his legal heirs and distribute his share among the remaining partners?
Will this affect the other businesses of the remaining 9 partners in any way?
