Q: Employee Dispute and Forgery One of our employees in the UAE took out loans from the company and then resigned. He forged the documents to cancel his visa with Shams as well. We want to file a labor department complaint against him.

Q: In a labor case, if anyone found forgery and other UAE law violations, will the court take it as a criminal case or labor case? The employer made a fabricated bill and won in the first instance, then in appeal court found the forgery. In that case, will the court take the forgery as a criminal case or not?

Q: I have had a domestic worker ‘nanny‘ under my sponsorship for 7 years. She decided suddenly to terminate our existing contract which will end after 4 months and ran away with her boyfriend! Tried to negotiate with her to come back till I search for a replacement but unfortunately, she did not agree. I usually take her with me to renew her working visa and contract in TADBEER. But last year, after reaching there, my son was sleeping in my car and she stayed with him. I had to sign the work contract on my behalf and her behalf in front of the officer who told me it is ok as she was our nanny for 6 years that time. I’m not sure if I finger stamped on her behalf or not. My question is: can she file a case that I signed on her behalf on the maid contract? If she did this, what will the consequences be on me? Q: Hello, My contract is not signed by me; it is signed by someone else, and the signature does not match mine. My company does this. Is it still valid? I plan to resign, and my contract mentions a two-month prior notice. Am I required to give a two-month notice period if I did not agree to it in the contract? Is it possible to give a one-month notice period instead of two months?

There are always conditions where people may fail to provide sufficient documents of a certain business or project they are willing to engage in, so they tend to commit an act of forgery with their documents to meet the requirements. The provisions of this Federal Decree-Law No. (31) of 2021 Promulgating the Crimes and Penalties Law, known as the "New UAE Penal Code", governs criminal actions in the United Arab Emirates. The New Penal Code repeals the previous UAE Penal Code (Federal Law No. (3) of 1987 Promulgating the Penal Code).
