Q: How can we get our security cheques back given to our client against an advance for an order?
Later, the LPO was cancelled after 170 days and we had already started the work for the job.
We have offered to give a non-transferable credit note to the client but the client is asking us to deposit an advance given to us against the LPO in the bank account of the client and holding our undated security cheques too.
The client has breached the contract by cancelling the LPO after 170 days while a part of the job drawings, structural calculations and other work were done.
Please advise how can we get our cheques back.

Breach of a pledge agreement and fraud by the developer

Q: In April 2017, AAK entered into a Pledge Agreement (the “PA”) with a Bond Holding Company (BHC) and a Developer (DEV).
As per the PA, AAK deposited an amount in the form of Bonds with BHC, pledged to DEV, to act as a deposit for a property.
AAK received a notice in Dec. 2017 and Aug. 9, 2018, from DEV stating that his signature on the Sale & Purchase Agreement (“SPA”) is pending.
In addition, the concerned notice falsely stated that the Property is registered with DLD in the name of AAK.
Despite several written requests for a copy of the DLD registration, DEV has not provided the same with a DLD registration dated on or before the initial date of the notice.
On January 17, 2018, AAK then discovered that the amount had been redeemed from his holdings.
The PA states it is being entered into based on the Reservation Form and the SPA which had been entered into by DEV as the Seller and AAK as the Purchaser; however AAK did not enter into any SPA.
Has the PA contract been breached?

Obtaining refund from the developer for project delay

Q: I booked an off-plan studio in R.E.P. DIP. The developer posts to me the contract to sign. I signed the contract and posted it back to their address.
The texture property In Dubai has been dealing and I transferred 10% to reserve the unit in June 2015. I have paid over 30% until the end of Dec 2016.
I stopped paying the rest of instalments because after viewing 0% construction report through DLD website and neither developer has provided me Oqood.
There is still no construction as per the DLD report for project number 1514. I am considering to get a refund.
The total price of the studio is AED 330000. 10% at the outset, 36 equal instalments during construction, 20% on handover and 18 equal instalments after the handover.
I have paid 10% and 18 equal instalments out of 36 during the construction as per contract. Total AED 109,973.94 paid: AED 109,973.00
What are the possibilities to get a refund from the developer? How much would it cost?

اشتريت وحدة عقارية في إمارة عجمان عبارة عن محل والمفروض الاستلام في سنة 2018 وتم التمديد حتى 2019.
نسبة إنجاز المشروع حتى اليوم لا تتعدى 57%. كانت هناك مخاطبات بيني وبينهم ولم يتم التوصل لاتفاق.
قمت بمراجعة دائرة التنظيم العقاري وتم الاجتماع مع المحامي والاتفاق على إرجاع وسحب المبلغ المدفوع من قبلي كاملاً من حساب الضمان بالتراضي بين الطرفين وقد وافق على ذلك محامي الشركة.
الآن حين تابعت الموضوع مع المحامي، قال إنه سيحضر عقد الفسخ وسألته هل سيكون المبلغ المُستَرد كاملاً لأنه من حساب الضمان؟ قال سيتم خصم نسبة باعتبارها رسوم إدارية وهي نقطة الخلاف معهم؛ فهل يُسمَّى العقد فسخًا؟ وهل يحق لهم اقتطاع نسبة من المبلغ المسترد من حساب الضمان؟
علمًا بأنني أستحق أيضًا مبلغًا تعويضيًا يجوز أو يحق لي المطالبة به.

تبرز الحاجة عند وجود تعاملات بين الشركات التجارية والأفراد لإيجاد طريقة ناجعة وسريعة لتحصيل الحقوق للدائنين، ومنها أوامر الأداء. الأصل حق الدائن في الالتجاء إلى المحكمة للمطالبة بحقه قبل خصمه، و الاستثناء الالتجاء إلى طريق استصدار أمر الأداء. وقد أجاز المشرع الإماراتي لكل من لدية سند دين مستحق الأداء ومعلوم المقدار وغير معلق على شرط أن يسلك طريق أمر الأداء لإقتضاء حقه.
