Amending the parties of a claim to include the real owners of the property
I won a real estate case last year and I'm at the final stage of execution against an LLC which has just little assets.
Today, I learnt that this LLC has never been the owner of my ex-property as incorrectly written in my SPA. Instead, all the properties of that project, including the land, belong to 2 individuals who are the real owners as named on the title deed that all buyers received after having paid the 4% of registration.
I would like to know how can I redirect my case towards those persons who still have a lot of assets in the building?

Hello,
As per your query, as all the properties are under the 2 individuals, and as the process with the present execution suit, you can file an application for interlocutory request for amending the suit, since the parties need to be amended and the claim needs to be submitted accordingly and then, wait for the court’s decision to accept the same.

Dear client,
Good day!
In similar cases, we were able to establish to the execution judge the relationship between those parties.
Please go to Land Department, get a letter explaining the relationship between the parties, or request the Execution Court to direct Land Department to give you such a letter that you can submit to the execution judge to proceed further.
For further assistance, please feel free to contact us via phone or email.
Thank you!
