Q: Earlier on this year one of the 25 foot Palm Trees in my garden was blown down in the high winds, luckily this Palm Tree did not hit the house or do any major damage. The reason for the tree blowing down was that the inside trunk had been eaten away by some kind of insects.At the time I raised my concern to the landlord that the other palm trees could be infected as well. A few weeks ago, I got the Palm Trees cleaned and one of the other trees has had half the trunk eaten away by insects. Now this tree could also potentially fall down in high winds.I have asked the Landlord if he could arrange for taking this tree down and remove it, but he says this is covered under garden maintenance and it is my responsibility.I must admit I was quite surprised that the Landlord took this attitude, as the tree could potentially fall on his property or the neighbours!Please let me know in cases for removals of trees from the garden, who is responsible for this, the Landlord or the tenant?

Breach of the lease contract obligations by the landlord

Q: We moved into a villa in August 2017 and we paid one cash cheque payment to the owner who is local, as he gave us a copy of his Emirates ID and contract.
In December, our water was cut and was told by ADDC that the water has not been paid since August, which we all donated and paid for as we are about 7 tenants in the villa (Studio).
On the 10th of this month, a legal notice came from the court showing First Gulf Properties that the landlord should appear in the court. He didn't show up to which.
Yesterday, another same one was sent to him to appear today of which I doubt he did go because all his numbers are off. I need to know what's my right in this.
NB: This property is in Abu Dhabi and I have a copy of the landlord's Emirates ID. I even took a picture of him and my husband with the agent, and a copy of the cheque I gave to him the day we signed the contract.
Please advise me.

Premature termination of tenancy contract due to defects of the property

Q: We have still 7 months left on our tenancy contract but the property has too many issues and in one room the ceiling has fallen down due to leaks.
Is there any way we can break the contract and receive the rent for remaining months and our security deposit back?

Landlord's responsibility to provide all basics while renting an apartment

Q: Hi,
I just rented a studio and I found out that the electric water heater in the bathroom is not working. The owner is saying he will not fix it as the rent is also low.
It's been 2 days I shifted to this apartment. The agent also didn't tell me this issue, otherwise, I should have ignored this.
How to handle this issue?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
