Q: I purchased an apartment in August 2007 which was due for handover on October 31, 2009. The purchase price was AED 1.42 million. The payment term was 50% in 7 instalments and 50% on project completion. I paid 50% as per the agreement, The developer informed me sometime in 2008 that the project was delayed due to force majeure as the substation in Business Bay was not complete. Now it is 2020 and the project is still not completed. The substation in Business Bay had been completed years ago. I would like to know if I am entitled to compensation for the delay or can I cancel the purchase in its entirety and get my money back along with interest? Please advise me on my options and what steps should I take forward.

س: كان لدي دعوى أنا المدعي بها لجان عقارية (-------) وقد أصدرت اللجنة حكمها بتاريخ 14-10-2020. ولكن تم إغفال الفصل في مبلغ قمت بسداده بالزيادة إلى (-------) وأيضاً قد تم سداد المبلغ إلى (-------) من خلال التمويل من (-------). قمت بتسجيل طلب إغفال وتم الحكم برفضه. ثم قمت بتسجيل طلب إغفال آخر، وقبل إصدار الحكم به، صدر المرسوم رقم 15 لسنة 2021 بشأن إلغاء اللجنة الخاصة. فأصدرت اللجنة قرار بإحالة الدعوى إلى المحكمة العقارية بمحاكم دبي للاختصاص ونص القرار على: "بسم الله الرحمن الرحيم بعد الاطلاع على المرسوم رقم 15 لسنة 2021 المعمول به من تاريخ 27-4-2021 قررت اللجنة مايلى: ــ أولاً:ـ إعادة الدعوى للمرافعة ــ ثانياً: إحالة الدعوى الى المحكمة العقارية بمحكمة دبى الابتدائية للاختصاص ولتحديد جلسة لنظر الدعوى والفصل فيها أصولاً بعد إعلان الخصوم" قمت بتسجيل دعوى عقاري جزئي وفقاً لقرار الإحالة الصادر عن اللجنة الملغاه، ولكن قد صدر الحكم في الدعوى عقاري جزئي "بعدم جواز نظر طلب الاغفال لسـبق الفصل فيه بموجب قضاء اللجنة الصادر بتاريخ ١٤-١٠-٢٠٢٠ باعتبار قرار اللجنة قراراً باتاً". ماذا يمكنني أن أتخذ من إجراءات؟

س: السلام عليكم، اشتريت شقة في الشارقة وتأخر المطور في التسليم لمدة سنتين وأربعة أشهر. أرسلت له إخطار عدلي من المحكمة في الشارقة بتاريخ التسليم وكان رده بأنه ملتزم بدفع بدل الإيجار عن الوحدة عن مدة التأخير. الآن العقار جاهز وتبقى مبلغ 90 ألف. طلبت منهم خصم مبلغ بدل الإيجار من دفعة التسليم ولكن المطور لا يريد دفع شيء ويماطل. اليوم أرسل لي إنذارًا يطلب مني استلام العقار ودفع دفعة التسليم خلال ٧ أيام وإلا سيلجأ للقانون. ما موقفي؟ وماذا يجب أن أفعل؟ العقار في الشارقة والعقد موثَّق. التأخير سنتين وأربعة أشهر. كان رد المطور على الإخطار العدلي أنه ملتزم بدفع بدل الإيجار. الآن لا يريد دفع شيء. ماذا أفعل؟ قيمة العقار مدفوعة كاملة ما عدا 90 ألف دفعة التسليم. أنا أطالبه بأن يخصم بدل الإيجار لكي أدفع الباقي وهو يرفض دفع أي شيء.

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
