Is it legal to import items and sell them knowing they are fake?

Hi,

I wanted to check the legal implications of buying a line of toys named "Funko POP!" from China [--------.com] and selling them on my own.

The toys are either fakes or exact replicas. Would I face any legal problems if I were to carry on with this operation?

Dear Questioner

You are violating the Intellectual Property and Trademark laws because the products are fake and copy of the original brand.

The Owner of the Trademark would have the right to proceed against you legally (Criminal & Civil ).

Hello,

I trust you are well.

While the sale of goods is monitored by strict laws in the UAE, which is equally as important is to confirm whether you are legally allowed to sell goods in the UAE.

For commercial purposes, you will be required to set-up a company for the sale of goods.

You need to be licensed by either the UAE mainland or free zones. We can assist and guide you through this process.

If the Trademark owner of the toys you plan to sell as fake or replica finds out that they're being sold by you or your company in the UAE, they can file a complaint in the Economic Department and all fake items will be confiscated and you will get a fine.
