Q: Kindly advise what can I do now that my visa already expired (expiry date is 04.04.2019). I keep waiting for my boss to have it renewed as he promised it will be renewed. The grace period is already finished and at this time, I have not received his advised for renewal yet. My labour contract is also not renewed. I am still working with them but I feel like somebody will just catch me as at this time I know I am over-staying. Is filing a resignation and complaining to labour the solution for my situation? I also have a credit card that I agree for a settlement a few months back, but since our salary is always delayed, the bank said they will cancel the settlement and will file a case. How can I check if I really have a case now? Can the police just put me in jail? Hoping you can somehow give me advice.

Q: I have worked for an employer for 22 days and now he tells me my services are no longer needed. He has not processed my visa and I only have an offer letter from him. I have been on sites and done his work but he says he doesn't need me and has thrown me out of the company. He is not ready to pay for anything. My visa status is currently cancelled from my old employer and I'm on the 30 days period now. My wife's visa is on hold in immigration and I don't know what to do. I want the money for the work that I have done for the past 22 days. Kindly advise.

س: لقد قامت الشركة بفسخ عقد العمل غير المحدد (فصل تعسفي) في شهر يوليو وأعطي لي شهر إنذار ولكن لم آخذ مستحقاتي منذ ذلك الحين لوجود بناتي على مقاعد الدراسة حتى الآن حتى 11/7/2019 والبحث عن وظيفة أخرى في هذة المدة وإقامتي تنتهي في 11/6/2019. قامت الشركه بتعيين موظفين آخرين منذ ذلك الوقت. فوجئت باتصال من الشركة يجبرني على إلغاء الإقامة الآن وإلغاء إقامة الأهل والبنات أولاً وأنهم غير مسؤولين عن تكملة البنات لدراستهم. أرجو الإفادة

س: كيف يمكن أن أطالب بمستحقاتي المالية قانونيًا من نادي رياضي قمت بإعطاء حصص رياضية فيه بصفة موظفة مستقلة بدون أي عقد كتابي، علمًا بأن النادي لم ينكر وجود مستحقات لي لكنهم لم يدفعوا أي جزء من المبلغ. هذه المستحقات تشمل بعض الأشهر من أعوام 2018 و2019 وبداية 2020. قمت بمراجعتهم أكثر من مرة، وفي كل مرة يعدوني أن أستلم في الشهر المقبل. مضى على هذا الكلام ما يقارب 6 أشهر علمًا بأنني لست المدربة المستقلة الوحيدة في النادي التي لم تستلم مستحقاتها، والمقلق الآن أن النادي بدأ يتعلل بمروره بضائقة مالية بسبب أزمة فيروس كورونا. يرجى الإفادة وشكرًا!

Three new ministerial decrees containing a new set of rules for the labour market were issued by the UAE Ministry of Labour last year and came into force on the 1st of January this year. The decrees are expected to alter the contractual relationship between employers and workers in the UAE.

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

According to this Decree, tentative approval to admit a foreign worker for the purpose of employment in the UAE cannot be granted until an Employment Offer that conforms with the Standard Employment Contract is duly signed by the employee and presented to the Ministry of Labour.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
