س: السلام عليكم ورحمة الله وبركاته، أستاذ محمد بخيت، لدي استفسار يتعلق ببلاغ هروب؛ حيث تقدمت بالاستقالة لشركة في دبي في شهر ٩ عام ٢٠١٩ وأعطتني الشركة مهلة لنهاية سنة ٢٠١٩ لتحويل إقامتي إلى كفيل آخر. لم أحصل على وظيفة ولم أستطع نقل الكفالة. قامت الشركة بفتح بلاغ هروب ضدي في شهر ٢ سنة ٢٠٢٠. كيف يمكنني إلغاء بلاغ الهروب؟

Q: Dear Sir, I worked in the UAE from 2009 until the middle of 2011. My company terminated me but they did not pay me the indemnity and the salary for the notice period. I wanted to leave the country that I could not stay there long without employment. Finally, I left without getting the dues and also without cancelling the residence. I filed a case at DIFC after I left the country and DIFC court made a verdict in my favour to pay AED 50000/-. However, the company filed an absconding case and as well another fake police case that I picked up some of the company files against me. I came to know about these cases when I checked with the authorities through another source later when I was planning to come to Dubai for another employment. Please note now it has been 7 years since I left the country, and I would like to know whether any of this cases may be still valid. And how can I clear myself out from this fabricated case? I would be grateful for your valuable advice. Thank you.

س: حصل نزاع مالي وبين كفيلي حيث كنت أدين له بمبلغ ٢٠٠٠٠ درهم. قام قبلها باستخراج تصريح عمل لذا قمت بتسليمه جواز سفري لإكمال الإجراءات، ولكن بسبب النزاع قام بإلغاء تأشيرة الإقامة وتعديل وضعي وقام بالتعميم ضدي دون علمي. وقد علمت بعد ستة أشهر من قيامه بذلك لذا راجعته وطلبت منه رفع التعميم ولكن دون أي جدوى. راجعت أحد موظفي تسهيل وسألته عما إذا كان بإمكاني إدراج طلب لرفع بلاغ هروب كيدي فردّ علي بأنه لا يمكنني طلب رفع بلاغ بسبب مرور أكثر من ستة أشهر. لذا كنت أراجع مندوب كفيلي حتى يفهمه وضعي ويقوم برفع التعميم ولكن دون أي جدوى. في عام ٢٠١٤م تم القبض علي من قبل شرطة دبي وإحالتي الى شرطة عجمان وبعد شهر تم تسفيري. ملاحظة: قدم كفيلي دعوى مدنية ضدي في محكمة عجمان مطالباً بالمبلغ قبل قيامه بإدراج بلاغ هروب ضدي وقد علمت عن القضية قبل سنة من تسفيري. سؤالي هل يوجد هناك وسيلة لإنهاء البلاغ الذي قام كفيلي بإدراجه ضدي وهل يمكنني العودة إلى دولة الإمارات؟ وما هي الاجراءات اللازمة لذلك؟

س: تم إنهاء عمل والدي في الشركة التي كان يعمل بها. طُلب من الوالد إنهاء إقامته وإقامة أبنائه ففعل ذلك ليُفاجأ بالصدفة بوجود تعميم بذريعة الهروب مع العلم أن الوالد موجود بالدولة ولم يغادرها وجواز سفره محجوز لدى الشركة نفسها. هناك خطاب فصل من العمل من الشركة وأيضًا لم يتم تسليم الوالد مستحقات إنهاء الخدمة ونتيجة لذلك تدهورت أحوالنا المادية والاجتماعية والنفسية وأيضًا تدهورت حالة الوالد صحيًا ولم يعد قادرًا على الحركة كما السابق. في ظل هذه الحالة، ما الإجراءات التي يجب علينا أن نتبعها لرفع هذا التعميم والتعويض عما تسبب به هذا التعميم الكيدي من أضرار مادية وصحية ونفسية؟ شكرًا جزيلاً!

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
