Q: Please, can you advise.
Our landlord is demanding a months rent penalty for not notifying him 2 months in advance of our intention to vacate the premises.
However, our contract does not request us to give notification. It has one clause which states: "IF the tenant wants to leave the apartment BEFORE the expiration date of the contract, he/she shall give 2 months written notice and pay 1 months penalty."
We are leaving on the expiration date, so how can we be in breach of the contract?
There are no other clauses or statements in the contract which refer to leaving notice required, and the contract itself has a clause which deems it null and void after the 1-year expiry date.

Q: Dear lawyer,
I have a tenancy contract for one year in Dubai, ending on 25 November 2018.
On the 8th of October, the landlord sent me a lease renewal, with some parts of the contract modified and contains different terms from the previous one.
I decided I don't want to renew the contract; neither with the new nor old conditions. On the 1st of November, I notified the landlord that I will vacate on the current contract end date 25 Nov.
He replied that I needed to notify him 90 days prior to the expiry date and I didn't, and now he is entitled to reimbursement and asks for 2 months' rent as a compensation.
Our contract says only "Tenant agrees to notify the Landlord in writing 3 months (90 days) prior to the expiry of this Agreement of his intention to renew or not renew the Agreement".
However, no financial penalties for breaking the clause of 90 days' notice of non-renewal are mentioned there.
Please tell, can he claim from me this 2 months' amount?
I will highly appreciate your opinion.

Q: Hi,
My rental contract expires in December 2016, however, since I can't afford the rent I am giving my two months notice to vacate the place by September 2016 paying 2 months rent.
However, the landlord tells me that I can't stay in the place during my notice period and I still have to pay rent for 2 months.
Please advise.

Q: Dear Sir/Madam,
My tenancy contract is ending on 28th November 2021. My landlord verbally expressed his intentions to sell the property on 19th August 2021.
Later on 5th September 2021, he sent me an email asking me to vacate the apartment at the end of the contract period (28th November 2021).
Is this legal or does the landlord have to give me a 12-month notice while renewing the contract?
What are my options in this scenario?

أختنا الفاضلة لدي مستأجر قمت بإخطاره بطلب إخلاء العقار (لبيعه) وبعدها بحوالي 3 أشهر تواصلت معه، ولكنه أخبرني أنه لم يستلم شيء من المحكمة على الرغم من أن تقرير شركة أرامكس يفيد بأنهم قد لصقوا طلب الإخلاء على باب الفيلا.
أرجو مساعدتكم الكريمة بالرد القانوني المناسب ولكم منا كل الشكر!

هل يحق لشركة عقارية تمديد مدة الإيجار رغم إرسال المالك إخطار بعدم التجديد؟

س: السلام عليكم،
لدي بيت مؤجر لشركة عقارية. وبحكم أني أعيش خارج الإمارات، تعرضت لنوع من النصب حيث لم يتم إخباري عن موضوع الإخطار القانوني لإخلاء البيت.
بعد درايتي بالموضوع أرسلت إخطارًا قانونيًا في شهر سبتمبر الماضي لإخلاء البيت، مع العلم أن عقد الإيجار حُرر في فبراير 2021 والإخطار القانوني في سبتمبر 2022 لأني أنوي الاستقرار في بيتي بالإمارات مع عائلتي إن شاء الله.
أريد من فضلكم معرفة هل يحق للشركة العقارية تمديد مدة الإيجار رغم الإخطار القانوني؟
صاحبة الشركة لا تريد التواصل معي حتى مستحقاتي (الإيجارات) لم أتوصل لها وبيتي معروض للإيجار على الإنترنت بعقد سنوي.
مع العلم حسب القانون، لا بد من تسليم المفاتيح في شهر سبتمبر.

س: السلام عليكم،
أسكن في شقة بالإيجار في بيت شعبي بمدينة العين بعقد إيجار غير قابل للتوثيق عن طريق مستثمر للبيت الشعبي.
المستثمر طلب إخلاء الشقة بدون إنذار أو إشعار كاف بحجة رغبته في تسليم العقار للمالك.
طلبت مهلة كافية تمكنني من البحث عن سكن بديل ومناسب، نظرًا لوجود طلاب في مدارس، فلم أعثر على الشقة المناسبة حتى الآن.
فوجئت بالمالك يرفع دعوى مستعجلة لا يعترف فيها بعقد الاستثمار ولا بعقد الإيجار بيني وبين المستثمر ويعتبر وجودي تعديًا طالبًا من المحكمة أمرًا بالإخلاء الفوري.
سؤالي للأستاذ المحامي:
كيف أرد على هذه الدعوى؟

Hi.
One of my friends joined a Telegram group. They said, "We will transfer some amount to your account, and your task is to transfer this amount to another account. Once the task is completed, you will get 30 or 50 AED per task."
He completed 3 to 4 tasks, but he realized it was not good, so he stopped. After one week, when he opened his account, it was blocked, and the bank said, "We are conducting an investigation; after this, we will let you know."
After some days, he had an accident and went to his home country. He then received a call from a landline number, which was from the Abu Dhabi police station.
They said, "We have received a complaint against you; come to our investigation department." However, due to his surgery and treatment, he could not go.
After some time, his bank account was reopened, and he did not receive any further calls. I want to know, if he comes back to the UAE or goes to any other GCC country, will he face any problems?
If someone has a case in the UAE, can they travel to another GCC country?

I need some guidance regarding a property transaction that is not progressing as expected.
My broker initiated a manual Memorandum of Understanding (MOU) between me (the Buyer) and the Seller, with an expiry date of 01/02/2025. Within this period, I successfully arranged the bank mortgage, property evaluation, and NOC.
However, the broker started giving excuses, such as the seller being hospitalized. Later, the broker attempted to arrange a Power of Attorney (POA).
However, after that, they started ignoring my messages and calls. It now seems like they no longer intend to proceed with me, and the MOU has already expired.
Meanwhile, my bank EMI has already started, and I have paid two monthly installments. The broker is still unresponsive. I have raised multiple complaints through DLD RVS against the broker, but the response has been very slow and unsatisfactory.
I’m feeling stuck and financially burdened.

I'm building my house in Dubai, and it was going well.
I gave the contractor 420k as a first payment, and we both agreed that the rest would be in installments. Just two months ago, the contractor went off the grid, and I can't find him.

I have resigned from my current job and my last day is May 9th after a notice period of 2 months. I was employed for 4 years.
My employer has paid me a full year housing allowance and would like to deduct the remaining months from my end of service. Is this allowed? I have not been made aware that the amount would be deducted in case I resign.
Also, I am entitled to 30 days of leave per year. Since I have resigned, they have applied a pro-rata for this year for the end of service calculation. Is this allowed?
Shouldn't I be compensated for the 30 days that I have not taken?

I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?
