27
Q: Ms. Nikhat,
I'm in India. Please advise on an ongoing issue with me for the last 2 years and for no reason, or you can say suffering without fault.
I have issued cheques in a settlement for my cousin regarding his civil case. It was a claim of 2.2 Million with dividing the amount into 12 cheques of 20k each, and rest of the amount of AED 1.7 Million approximately in 13 months.
Where it was clearly written in the agreement that as soon my cousin got his chequebook from the bank, all my cheques get replaced with the new one.
As it took 2 months to get the new chequebook because of cousin's visa expiry, the other lawyer refused to replace my cheques and said if you want to replace they will keep my cheques as a guarantee.
So we could not replace them with new cheques. He put my cheque into the bank and I left the country in August 2016. I'm still out and only my cousin is there in the UAE arranging the fund without any success.
I lost my 12 years of Dubai experience and doing nothing. I don't know if I will face any issue in immigration for Qatar.

Can I be caught in GCC countries for my UAE bank debts?
83
Q: I have a loan with UAE bank: 1 credit card outstanding value is 22,000 AED & one personal loan around 85,000 AED. I lost my job on Jun 2016. From there I unable to pay my EMI (6 months). Bank is not agreeing for settlement plan as per my request. Now they are saying they are going to file a case. Now my doubt, if I get a job in GCC other than UAE, will police catch me in the airport in any GCC? OR arrest is possible only if they file a case in that particular country? Please, advise.

Will I be arrested in GCC countries for my UAE credit card debt?
50
Q: Greetings,
I was terminated by my company in May 2016 because they were cutting the number of staff. I had a credit card with 10,000AED that I used fully. I was unable to reach the bank and so far I have never received any call or email from them.
I was struggling with unemployment all this time and couldn’t pay my debt, I have no intentions to not pay because it’s Haram/prohibited in my religion. Recently, I got a job offer in another GCC country and I want to go there and pay my debt using my salary.
My question is, will I be arrested in that GCC country at the airport?
I don’t know if a police case has been filed against me or not, what I know is I am morally obligated to pay my debt and the only way I can do it is if I start that new job, my family is poor and my country has no job opportunities.
I’m afraid to be detained and sent to the UAE, this will not solve the issue, nobody will be able to pay for me and jail won’t solve the problem.
Any help is greatly appreciated. Regards.

Bank filed a civil case over a loan: Better to settle with the bank or in court? 0
Good day, Sir,
I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?
Best regards,

Is it legal for my employer to withhold my salary until I leave the country or change status? 0
Hello,
I have given my notice, and my last day is July 24, but the employer is refusing to pay my salary; even the salary for June. Is this even legal?
He claims I'll get everything at once, which is after leaving the country or changing status.

Demanding that an employee pay for visa charges a year after resigning 0
Dear Lawyers,
I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
What should I do about this? My monthly salary is only 2,800 AED.

If someone has a case in the UAE, can they travel to another GCC country? 0
Hi.
One of my friends joined a Telegram group. They said, "We will transfer some amount to your account, and your task is to transfer this amount to another account. Once the task is completed, you will get 30 or 50 AED per task."
He completed 3 to 4 tasks, but he realized it was not good, so he stopped. After one week, when he opened his account, it was blocked, and the bank said, "We are conducting an investigation; after this, we will let you know."
After some days, he had an accident and went to his home country. He then received a call from a landline number, which was from the Abu Dhabi police station.
They said, "We have received a complaint against you; come to our investigation department." However, due to his surgery and treatment, he could not go.
After some time, his bank account was reopened, and he did not receive any further calls. I want to know, if he comes back to the UAE or goes to any other GCC country, will he face any problems?
If someone has a case in the UAE, can they travel to another GCC country?
Please advise!

How can we locate a person with an ongoing legal case? 0
Hello,
I am seeking your legal advice regarding a friend who was previously imprisoned in Abu Dhabi. His case there is now closed, but he has another ongoing case in Dubai.
Currently, we have lost contact with him and are unsure of his whereabouts. How can we check where he is or access any other legal facility?
Are there legal procedures to locate a person with an ongoing case?
What steps should we take to get more information about his status and legal position?
