Q: Good day,
My situation is that I submitted my resignation last October 5 effectivity same day, in hard copy.
I also emailed it to my manager and sent it on WhatsApp to my boss and manager. They saw my resignation in WhatsApp but my manager doesn't accept my hard copy because he said that he doesn’t want to have problems.
So, I messaged my boss through WhatsApp and he doesn't seem to care about it. They told me that I have to pay the visa cost before they give me my passport.
I talked to the Labor Department and they said I should only pay my employer 45 days of my salary, and I am willing to pay the 45-day salary for resignation but my boss is asking to for the visa cost also. He said he knows his rights and I must pay more than just the 45 days salary.
Please help me, I don't know what to do. I need to get back urgently to the Philippines.

Labor ban on limited period contract

Q: I have a limited period contract for two years and I want to resign as per the internal contract (2 months).
I received another offer from a different company, and both companies are in Dubai.
Can the employer impose a labour ban on me?
If I get a labour ban, and since the new company is a free zone company, will the labour ban has effect as well?

Q: Dear Sir,
I would like to seek advice for my daughter (21 years old). She works in a trading company in Dubai with Unlimited Term employment contract from 21/11/2017.
She works as a Sales Executive under the provision of a month of probation period.
If she resigns from this job, will she be banned? Will she pay AED 7,000 as written in her Job Offer Letter?

Q: My company which is under JLT free zone applied for the closing of their business there because they opened a company in the mainland.
Before the final application of closing the company, I resigned from work (Please note that I am under a limited contract-free zone).
My boss wants me to serve my notice period on their mainland company. Is it legal?

Q: Dear Sir,
I hope you are doing well.
My neighbour brother went earlier to Dubai for packing work in a hotel for 2 months. Due to the condition of work & not getting a proper salary, he decided to resign from his job.
When he intimated the same to the employer they said he should pay AED 4500 before leaving & his own ticket. He is from a very poor background that's why he came for AED 900 salary.
But he gets actually 750 only without food. Need your kind support to help him to come back to India.

Q: Will I get a ban if I file a resignation or ask for the cancellation of my visa?
I did not sign an offer letter or a company contract. I only signed a labor contract held in Tasheel.
I have a 2 years-limited contract and I have spent 8 months at the company.

Resignation from a hospital to take another governmental offer

Q: I am working as a registered nurse in Abu Dhabi in a reputed hospital. Recently, I got an offer from a government hospital. I am planning to resign from my hospital, but they said that they will issue a 1-year ban against me and I need to pay 3 months salary.
My contract is limited and I have just completed my 2 months.
Would anyone give me a clear idea?

Q: Greetings!
I am a home care nurse for a private company here in Dubai, worked for 1 year in service under a limited contract.
Due to some problems with my DHA licensing, I cannot proceed to apply for the license unless I decide to go back to my home country & fill in my gap year there.
With this, I decided to talk to my employer that I want to resign so I can make use of the DHA RN exam that I passed when I come back here again next year.
But unfortunately, they told me I cannot resign because they helped me process the exam and funded it even though all the expenses were deducted from my salary.
They told me if I do so, I will have to pay the cancellation fee & the 45 days salary which I am willing to pay. I am planning to come back here to Dubai after a year, so I would like to ask if the company can ban me from entering and applying here again?

Non-payment of share value and claiming the shares back 0
My company is located in Dubai as an LLC. We have two shareholders,
1. UAE national shareholder with 95%
2. A foreign shareholder with 5%
The UAE national shareholder transferred this 5% shares to the foreign shareholder through a share sales agreement, which was notarized at the notary public in Dubai and submitted it to the DED to amend the trade license etc. This happened in 2014.
But till this date, the foreign shareholder did not pay the value of 5% shares to the UAE national shareholder or to the company.
Also, the foreign shareholder was not actively involved with the company's operation and as per Article 17 of the Commercial Companies Law:
"2. The partner may not contribute in work rendered unless he is a joint partner. The contribution of the partner may not consist of his having reputation or influence."
Under these circumstances, is it possible for the UAE national shareholder to request from the court to cancel the 5% shares of the foreign shareholder and transfer back to him?
