Terminating an employee due to misconduct
Good morning,
I gave an employee a notice last week that we will be closing the position and I gave him a notice period of 3 months. The employee refused to sign the notice letter stating that he will read it and get back to us on Sunday this week.
In the letter, it is stated that he has to keep me informed of all activities regarding our business during the notice period. He must not make use of confidential information over the notice period as well.
The employee has not kept in contact with his activities regarding clients and, yesterday, he walked into our client's office and took copies of all our consignment stock agreements without informing me, the client sent me an email confirming this.
What action can I take against this employee?
Dear questioner,
As an employer, you can use article 120 of the UAE labour law to terminate him with immediate effect without any payment of his dues.
Further, please notify the labour department of the same incident within 48 hours of the occurrence of the incident so that you are well protected even if the matter goes to the labour court.
Kindly contact us via phone for a detailed discussion or write us an email for further assistance.

Hi,
Based on the information provided above, your employee has breached confidentiality that he is obliged to maintain.
Therefore, through provisions laid out under UAE Laws, we can assist in notifying the employee of his violations and the penalties that he must pay to the employer for the damages suffered.
For further information, please contact us via phone or email.

Dear Sir,
With reference to the above-mentioned subject, we need to clarify a point. Did he (employee) use this information?
Hence you need to notify the employee that you are aware of what he has done and if he uses the information of consignment stock in the future you will sue him regarding breach of trust, dishonesty, and dissipation.
