Q: Does an employee have to sign any paper with the employer to initiate his visa cancellation after the resignation and before last working day?
My employer is asking me to sign a form named "United Arab Emirates Ministry of Human Resources and Emiratisation Electronic Work Permit Cancellation", where all my details are printed and written, "I certify that I have received all my dues up to date... Employee Signature".
My notice ends on Aug 29th and they are yet to pay end of service...etc., and this is an unlimited contract and my employer is asking me to sign this paper saying this should be signed to initiate visa cancellation.
But I am uncertain to sign as I haven't received my pay yet but the paper says so.

Q: I work for a company in IMPZ Dubai. I resigned on June 23 & my last working day was on July 22, 2018. My employer has not paid 2 months' salary & gratuity till date.
The company forcefully asked me to sign the cancellation paper and my visa got cancelled on August 16.
I have an email from the vice president of the company dated August 24 confirming that my settlements will be paid soon, and they mentioned in my settlement calculation that my dues will be paid upon visa cancellation, as this is their company policy.
Few other employees have left the company recently & the management followed the same process. i.e. visa cancellation first and then settlement of dues.
Kindly advise, how can I get my rights?

Q: Dear Mr Khalifa
I have recently resigned from my company in Dubai where I have worked for over six years. Currently, I am serving the notice period up to 30th June 2019.
I resigned on 11th June 2019 but my company is asking me to serve 30 days notice period. The reason for leaving is they are not paying me my salary on time which has now increased to almost three months.
My dues include 3 months salary (April, May and June 2019), 6 years gratuity and 10.5 days annual leaves. The total amount due is around AED 115,000.
When I asked my company to cancel my resident visa (which is already expired on 22nd June 2019), they have sent me the final settlement which states the following declaration:
"I, the undersigned do hereby certify that I have received all my dues from my Company/Institution and I have no right to make any claim after this date."
I told my company that the dues are not cleared yet, how can I sign this form? but they are saying that this form will not affect my dues.
Please advise.

تلقيت فصلاً من شركتي بعد ثمان سنوات عمل وطلبوا مني عمل تعليق لإقامة أولادي حتى يلغوا إقامتي.
طلبوا مني كذلك توقيع إلغاء تصريح العمل ولكنهم لن يعطوني مستحقاتي كاملة إلا بعد عمل التعليق.
هل هذا قانوني؟ وهل إذا أعطوني صورة الشيك بالمستحقات هذا يكفي للمطالبة به أم أنني عند توقيع أني استلمت كافة المستحقات لا يمكنني مطالبتهم بها لاحقًا؟

Q: Hi Dear Sir or Madam!
My company visa is about to expire in the month of July and my ten months salary is in pending the owner says today and tomorrow I will be giving it to you.
So what should I do if the owner asks me to sign the cancellation and I never want?
Will I pay the overstay charges or my employer will pay the fine?

أعمل في فندق حكومي. لم أستلم رواتب أول ستة أشهر من العمل. تعرضت لضغوطات كثيرة من طرف المدير؛ مثل: العمل لساعات إضافية مجانًا، وتغيير موقع العمل كل يومين، وإعطائي عقوبة الجلوس في البيت بدون أي مبرر لمدة شهر مع العلم أنني الوحيد الذي يتعاملون معه بهذه الطريقة.
عندما تكلمت عن حقي مع المدير، أحضروا ورقة إنهاء الخدمة ويجبرونني على توقيعها يوميًا ويحاولون منعي من دخول الفندق، وكذلك إخافتي وتهديدي بإحضار دورية الشرطة في المرة الأولى ورجل مباحث الفنادق التابع لشرطة أبوظبي في المرة الثانية والذين هم أصدقاء المدير.
مع العلم أنه عند محاولتي فتح تطبيقات مثل تطبيق ICA أو MOHRE أو UAE Smart ID، أتفاجأ أن رقم هاتف الفندق أو مندوب الفندق هو المُسجّل في قاعدة البيانات الخاصة بي في الجوازات.
أطلب مساعدتكم لإرشادي. ماذا أفعل لأنني مقهور أقسم بالله؟

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
