Can a transfer of the deceased company shares be revoked for being technically defective?
1
Q: A transmission to ultimate beneficiaries seems to be technically defective from the wording of the deceased's Will.
The Shares of the Deceased should have been transmitted to 3 Trustees including the living spouse of the deceased but instead, they were transmitted to the ultimate beneficiaries named in the Will (including 2 of the Trustees but excluding the living spouse of the Deceased), which transmission would take place only upon the death of the living spouse.
My question here is, can the defective Transmission be revoked and rescinded by the Board of Directors & the entries in the Register Of Members kept at Companies Commission be reversed back accordingly? Instead of going through a formal Transfer of Shares to reverse the transaction.
Thereafter, a proper and correct transmission is to be done, transmitting the Deceased's shares to the 3 Trustees as stated in the Deceased's Will.
Would appreciate advice on this matter.
Thank you

Can the daughter claim her rights of inheritance after her father passed away?

0
Q: Please I want an answer in Sharia.
The father of a Muslim UAE national gave in his lifetime his business share to 3 sons and 3 daughters.
He did not give any share in this business to the 4th daughter. The 4th daughter came to know he did not give her rights after his death.
Is there any way she can go to sharia court for justice?
Thanks and regards,
A detailed answer will be highly appreciated.

My father was partner in a company in Abu Dhabi and passed away. How to transfer his shares?

2
Q: Hi,
My father owned a company in Abu Dhabi and had some shares there. He passed away in India last year and did not leave a will.
My mother and I are Singaporeans. We want to transfer his company shares to someone else.
May I know what is the exact legal procedure, please?
Do we need to get the Death Certificate attested?
What documents will we need to produce?
Do we need to obtain a Letter of Administration in Singapore first before coming to the UAE?
Thank you so much for your kind advice.

Do daughters have the right to know information about a business fully inherited by mother from father?

1
Q: Dear Lawyers,
My deceased father owned a business in the UAE. He has a will stating that all property and the ongoing business go to my mother after him.
My brother is part of the business, and my mother stays with him. I want to know, as per UAE law:
1. Do married daughters have any rights to be informed about the business's health?
2. Can married daughters claim any share or role in decision-making for the business, given that the will states that after my mother, the inheritance will be equally shared among siblings?

In 2016, Dubai introduced an exceptionally unique solution to entertain basic asset protection needs to Foreign Investors and Expat Residents living in Dubai. They can now be 100% sure their assets are fully protected against any problems that may arise because of the forced heirship system applied by the Sharia Regulations in the United Arab Emirates, or any other conflict between the religious laws of succession between the person and the state where he lives and invests.

Securing Your Assets in the UAE by Registering Your Will 14
Do you have assets in the UAE? Have you made a will yet? It is highly recommended to register a will soon, otherwise, the drive to asset disbursement can be extensive and expensive. In addition to the option of registering a will in DIFC for Non-Muslim will registration, Abu Dhabi Judicial Department (ADJD) had also introduced a separate office since August 2017, which has made the entire will registration process easier and cost-effective.

If someone has a case in the UAE, can they travel to another GCC country? 0
Hi.
One of my friends joined a Telegram group. They said, "We will transfer some amount to your account, and your task is to transfer this amount to another account. Once the task is completed, you will get 30 or 50 AED per task."
He completed 3 to 4 tasks, but he realized it was not good, so he stopped. After one week, when he opened his account, it was blocked, and the bank said, "We are conducting an investigation; after this, we will let you know."
After some days, he had an accident and went to his home country. He then received a call from a landline number, which was from the Abu Dhabi police station.
They said, "We have received a complaint against you; come to our investigation department." However, due to his surgery and treatment, he could not go.
After some time, his bank account was reopened, and he did not receive any further calls. I want to know, if he comes back to the UAE or goes to any other GCC country, will he face any problems?
If someone has a case in the UAE, can they travel to another GCC country?
Please advise!

Termination of off-plan apartments' contract without sending written notice 0
I purchased 2 off-plan hotel apartments in 2016; both ACD Q2, 2018. One is 100% paid, the other is 30% as per the SPA.
According to SPA:
"Without prejudice to the Seller's rights under Clause 21 in respect of a Force Majeure Event and/or Foreign Delay Events, the ACD may be extended by the Seller, in its absolute discretion without cause, by written notice to the Purchaser for a period or periods of up to a total of twelve (12) months."
No written notice was received, despite requesting it on 21/09/2018 by email (no reply).
After several misleading communications and changing completion dates, they are now saying that because I did not exercise my entitlement to send written notice requiring completion of building works within 1 year from ACD ("Remedy Period"), I am not entitled to terminate.
I didn't send this notice as I was waiting for them to send theirs as per SPA obligations. Current RERA status is 61.59% (due 30/06/2020)and 84.54% (due 31/05/2020).
Is this a good cause for termination?

Getting a new employment visa while a cheque bounce case is being processed 0
Hi All,
I have an existing criminal "cheque bounce" case under my name for dishonoring loan payments. I'm also a victim of unpaid salaries and gratuity from the previous employer.
However, I have reached a stalemate in negotiating with the bank as they are not interested in accepting the money I could offer in the interim despite having a clear understanding of my predicament.
Finally, I have an offer from a company after all these months and I'm anticipating to accept this offer but I'm yet to resolve the criminal case!
Since the bank is not willing to negotiate, I've planned to pay the criminal case removal fee or fine to the Dubai Police. I know that the bank would immediately proceed with a civil case should that happen.
My question is how long does it take to file a civil case? And can they initiate a travel ban without appeal while filing the civil case in court?
Will it affect my capacity to get a new employment visa stamped and work in the UAE while the civil case is active?
