Q: Hi Sir,
I am staying in a shared apartment for the last six months. No tenancy contract. I couldn't pay the rent for August and September.
I have given a cheque dated 3rd October, but the landlord is behind me every day. Today, he changed the key and locked the room.
What should I do? He is not listening to me. He is shouting at me.

Q: Dear Sir,
I need an advice on my three rental cheques of AED 4800 each, which bounced in Sharjah and the landlord has filed a complaint in Sharjah Police Station.
Alongside, the court has ordered to vacate the place. I have been jobless for the last 15 months and I have told the judge about my condition.
What do I have to do now? As per the new rule on cheque bounce, can I hire a lawyer and pay a fine for my bounced cheque and be released from the police station so that I can apply for a new job?
Please guide me.

Q: Dear Sir,
We have a tenancy contract from January this year for a villa in Springs. The rent was to be paid in 2 cheques, out of which we have paid one and the 2nd cheque was dishonoured due to financial trouble.
My husband is currently in custody for some bank related case and my son is on his own at the house. The landlord sent us 30 days' notice through notary that expired yesterday.
Can the landlord evict us from the property because we are not in a situation to pay till my husband is out of the legal trouble?
We have applied for his bail but the landlord is not ready to cooperate.
What is the process for them to get the house evicted because our intention is to pay them but we need some time? Can you guide us, please?
The problem is every other day the landlord comes and harasses my son by knocking on the door and calling every day.

س: يطالبني المالك بإيجار عن فترة ما بعد إخلاء العقار بالرغم من أنني أبلغته بعدم الرغبة في التجديد ووافق مقابل غرامة تُستقطَع من التأمين لأنني أبلغته قبل أقل من ستين يوم من تاريخ نهاية العقد.
منحني مهلة عشرة أيام لنقل الأثاث وسلمته العقار وقام بمعاينته واتفقنا على الاستقطاعات من مبلغ التأمين والتي كانت تساوي مبلغ التأمين كاملاً تقريبًا.
أرسلت له براءة ذمة من المرافق وتم كل ذلك عن طريق محادثات إيميل وأبلغني أنني في انتظار شيك بباقي مبلغ التأمين، وكنت على علم أنه يعرض العقار للإيجار ولكنني فوجئت بدعوى ضدي بزعم أني لا أزال قاطنًا للعقار.
يطالب بطردي وأجرة حتى تاريخ طردي.

س: السلام عليكم،
استأجرت سكن لمدة سنة وطلبت من المالك عدم التجديد وعمل براءة ذمة وسكنت في مكان آخر بعد أربعة أشهر. بعد سنتين أوقفتني شرطة المطار وأنا قادم من بلدي وأبلغتني أني مطلوب لدفع مبلغ إيجار سنتين لمالك السكن مع أنني لم أسكن به هذه المدة.
توجهت إلي بلدية الشارقة وطبعت أوراق القضية ولا أعلم ماذا أفعل؟
مع العلم أن المالك لم يُخطرني أبدًا وهناك مَن كان يسكن من طرف المالك، فماذا أفعل؟
كلمت المالك فقال لي بالحرف: "ادفع وبعد ذلك ساومني وحبة عليك وحبة عليّ"؛ أي نصف المبلغ (٢٠ ألف درهم) بدون وجه حق وأنا أسكن مع أولادي في مكان آخر في هذه الفترة ولدي شهود.

عدم الانتفاع بالعقار المؤجر بسبب عدم دفع المالك للرسوم. ما الحل؟

س: السلام عليكم،
لدي عقد إيجار مُوقَّع من صاحب العقار منذ أكثر من ٥ أشهر. إلى الآن لم أستطع استخراج إيجاري بسبب أنه لم يدفع رسوم مستحقة عليه والعقار محجوز في الإيجار.
حاولت التواصل معه بالهاتف والوتساب والإيميل ولكن لا يوجد رد.
ما الحل الآن وأنا غير منتفع من العقار طوال هذه المدة؟

What can I do if my creditor used my blank cheque to put an amount more than my unpaid balance? 0

I have issued a blank cheque for my EMI, and now the company is using my blank cheque and putting any amount to deposit it.
My total unpaid balance is AED 19000, but they mentioned AED 42,030 on the cheque and another AED 10000. They told me they will deposit it to file a case.
