Q: I was diagnosed with a liver disease and the doctor took a liver biopsy and when I came to see the result of the lab I was informed that they did not send the sample to the lab on time as the lab was closed for one day and then they forgot to send it again and after a week they present it to the lab and they informed them it was too late as the sample is damaged since it is supposed to be sent within 48 hours. Now I have to make another biopsy - which is for your information is not an easy procedure - for a mistake made by the hospital.
Can I claim for compensation?

Q: Hi, I just wanted clarification on something.
I recently wrote to a clinic where I had a bad experience - in a private email - to complain about the service. The clinic has now threatened me with breach of Federal Law. I haven't published anything on social media but did say in my email that I wouldn't recommend the clinic on platforms where families chat about which clinic they should choose for IVF.
How much in trouble am I with the Clinic? What can they do? I was just expressing my personal experience!
Thank you.

Medical negligence and legal remedies in Dubai

Q: Good morning,
I had two surgeries two years ago. After the first one, I needed to have another one based on lab results. After the second one, I developed severe complications (the doc briefly mentioned it on the consent and I signed it).
I was misdiagnosed twice at ER at two different hospitals and was only diagnosed overseas while on holiday. I required surgery, however, it didn’t help and two months later I had another surgery in Dubai.
Again it was unsuccessful and I had another surgery two months later. This year I had another surgery.
The complication from the original surgery is severe and lifelong and I’m facing so many difficulties. Every doctor I saw after that said they did a very bad job and it’s extremely hard to fix it.
Lab results from the original surgery say that all the tissue they removed was healthy and nothing was found. However, the doctor removed a big part and now I’m facing problems.
I need an advice if I should file a formal complaint with the authorities.
Thank you

Breach of the patient confidentiality by the hospital

Q: The hospital I visit provided my information to someone calling pretending to be my husband.
I don't have a husband. Now, the hospital says they only provided my appointments, but even then it's still a violation of my privacy.
And they won't let me listen to the phone record. What can I do?

Claiming compensation for malpractice and failing to diagnose cancer
1
Q: Hello,
I went to my doctor in June 2019 with a lump in my breast. I had an ultrasound and mammogram and was told it is nothing (I now have the report which advises a biopsy. This wasn't done).
In March 2020 I went back and said it had grown. She still said it was fine and I demanded investigation. An ultrasound was done. Again she said it was fine.
I demanded a biopsy but she then said lockdown is about to happen. I stupidly accepted this as she said it was fine.
In May I was in the ER with unbelievable pain. I have stage 4 breast cancer which has now traveled to multiple bones. It is incurable.
I am in Dubai alone and the insurance will run out soon even though I haven't really started the treatment properly.
Do I have a case and will someone take me on pro bono?
Thanking you in advance

Medical treatment provided to patients does not always achieve the desired results, and sometimes it may lead to catastrophic consequences that cannot be remedied. This is due to several factors, some of these factors are related to the therapist or to the patient himself, or even related to God's will. It was, therefore, necessary for the legislator to intervene and develop the laws governing medical malpractice cases and set the limitations of liability for the therapist in such cases.

I am currently working in a company and I have saved enough money to start my own business, however, I fear that there might be some legal complications and high legal costs in establishing the company, Can you tell me the procedures of establishing a limited liability company and do I really need to hire a lawyer to do it or can I do it myself?

Labor appeal 0
My employer has filed an appeal to the Dubai Court decision on our labor case where they did not show up by submitting a backdated termination letter showing termination before the filing of the labor case.
I have the pic of actual termination letter which I was asked to sign after the labor case.
Actual timeline 21-07-2015 labor case filed, 27-07-2015 I was asked to sign termination which I didn't backdate, the document shows 18-07-2015 before the labor complaint.

Tadawul Account early close out 0
I'm a UAE resident and hold an account with "Existential Group" aka "Tadawul"... Their contract is fairly basic but they have specified payout periods etc yet I've been struggling with them since December to get money out, on the first of this month I always formally requested to close the account and have all monies paid out yet not a single person is able to comply with this instruction. I'm desperate for the money which is legally mine. I have stressed to them in email and numerous phone attempts but no one response. I'm currently out of UAE and only back on 9 April so am finding this extremely stressful trying to retrieve my finances. Are you in any way able to assist, if so how and what costs could I face doing so? Thank you in advance

Short term lease in Dubai 0
There are many of private apartments in Dubai advertised as holiday homes for short-term rent. As far as I know, there is a special regulation of such leasing in Dubai, requiring a permission from the government authorities. How can I be sure, that booking of an apartment for a short stay, let's say through Airbnb, is legal? What documents should I ask from the landlord to be on a safe side?

Service charges 0
I am the owner of the property and I am entitled to pay all the service charges to the management company. For the last year, the cost raises almost twice with no reason.
So I have raised this question within my community and we are now 11 people wanted to file an investigation case to know why we are paying more the landlords next door in the same area.
What are the procedures from here?
