Q: Hi Ma'am,
My company did not pay my final settlements till now as I resigned from August 2018.
I filed a case in MOL and I am waiting for the court judgement paper. My visa was cancelled in August and now I'm overstaying in the UAE.
Please clarify my question. If my company did not pay this overstay fine, what action do I need to take?
I want to go to my home country. I am not changing any job here.

I am about to file a case against my employer.
My employment visa will be expiring in the fourth week of April and I want to get a freelance visa or register with a freelancing company. Is there a way I can do this?

Q: Hi,
I had a labor case and the judgment came. The company has to pay my dues. My issue is that I have overstayed for the last 3 months.
I filed the execution already in order to get my dues from the company. I requested my company to cancel my visa. But they are not canceling me.
What can I do in such a situation like this?
Is it possible to cancel my visa by myself?
If yes, do I need to pay the overstay fine?
Is there any possibility to avoid the fine?

Q: Hi
I have an active labor work permit but I don't have a residence visa due to the expiry of my company license.
There is immigration overstay fine for 300 days. Hence I gave my resignation without notice period. I left the company.
The employer made a fake case against me for damaging their tools. Judgment came and dismissed that fake case.
Now I need to cancel my labor contract and clear the visa fines.
Please advise.

Claiming the EoSB and pending salaries while the visa is canceled

Q: Hi,
Good day!
I have been working with a company for 24 years and a half. Then I resigned because I did not receive a salary for almost 1 year.
They have already canceled my visa but when I asked about my gratuity payment and pending salaries, my manager told me that I can get it within a month or two and that if I still didn't receive it, just told me that they will contact me if ever the cheque is ready.
My question is:
Do I still have a chance to get my entitlement such as a guarantee of receiving my gratuity, and pending salaries despite my visa being already canceled?

Can I receive EOSB after my visa cancellation with MOHRE if I didn't claim it?

Q: Dear Lawyers,
I complained to MOHRE to cancel my visa, and I did not claim my EOSB (gratuity and leave salary) as I was thinking I would file a separate complaint for it.
I wanted to start my business as soon as possible, or else I would have lost many clients. After the cancellation, I found out that I can no longer claim my EOSB.
What should I do next? I am planning to file the case again after a month. Should I complain again to MOHRE after a while?
Will they accept it? Or should I go directly to civil court or labor court? What will the total cost be?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
