What to do when the employer withdraws the job offer?
My husband got a better offer from a new company so he resigned from the current job.
Everything was ok, but now after sanctioning work permit & e-visa, they refused further proceedings. They said that they don't want a new employee.
We are in dilemma, what to do next? Is there any legal action to take against the company?
Dear questioner,
I assume your husband has already signed a new offer letter from the new company before submitting his resignation.
If he did not, then there is not really much to help you or him in this case, unless he has any other sort of communication in writing like an email confirmation that we can review to decide if we can rely on it or not.
On the other hand, assuming that he did sign an offer letter with the new company, we should be able to review it, and based on the content, we can file a case against the new employer for compensation of the damages caused by their withdrawal of the offer letter.
I would go to claim as far as 1-2 year salary plus the relevant benefits.
