Q: Hello,
Two of my legal entities have provided services to a Dubai-based company [-----]. For over a year now, I've been trying to get this company to pay my invoices.
The company does not dispute the invoices but always pretends that the invoices have been paid and produces meaningless proof that payments were made (whereas no payments have been made).
Our agreement for the services was oral but has said the company does not dispute the need to pay but just does not. What legal options do I have?
I am based in the Netherlands.
Kind regards,
D.

Claim for outstanding amounts against provided services

Q: Hi,
We are a technical & cleaning service provider. We worked on the facade cleaning of Hotel Apartments and submitted our invoice on the 18th of March 2018.
As per our contract, we receive our payment within 15 days after the submission of the invoice. But this time we are chasing them for the 15 days period which was on April 4, 2018.
Every time we ask, their finance department was replying that the signatory is not available. Yesterday, the 28th of July, we arranged a meeting with their GM and discussed everything with him.
We were shocked that the GM said: "Go to the police, we will not pay you anything." I replied, "Why"? He said, "The management is not willing to pay anything to anyone".
We have the contract with them, a copy of the submitted invoice, and photos of all work progress.
Advise us, what should we do?
Regards,
S. S. H.

Claiming unpaid fees from a client for provided services

Q: This is related to a commercial question (B to B). I sold manpower services to a company. They have not paid my invoices.
According to the contract, they are obliged to pay us a 2% penalty per day on the outstanding balance, if they don't pay the outstanding balance by 15th of the following month.
Is it enforceable in the courts of law in the UAE?
My license is from SHAMS, Sharjah.

How to claim money from a UAE company against provided services

Q: We as an Indian company provided software services to one of our clients in the UAE (a private company) in 2017.
Since then, the customer is delaying the payment, and now we have offered him a 50% net discount on their payable as requested by them. Even with this, they are not paying.
What legal action can be taken against them?

Taking possession of a customer's vehicle if he has an outstanding bill

1
Q: Hello,
I am the owner of an automotive garage in the UAE. I have a customer who has an outstanding bill and has not collected their vehicle yet.
Every time the customer claims they will come to collect their vehicle and close their outstanding payments, they end up lying and ignoring calls for weeks.
Is there any form of legal action I can take or a way I can legally possess the vehicle after a certain time period?

If someone has a case in the UAE, can they travel to another GCC country? 0
Hi.
One of my friends joined a Telegram group. They said, "We will transfer some amount to your account, and your task is to transfer this amount to another account. Once the task is completed, you will get 30 or 50 AED per task."
He completed 3 to 4 tasks, but he realized it was not good, so he stopped. After one week, when he opened his account, it was blocked, and the bank said, "We are conducting an investigation; after this, we will let you know."
After some days, he had an accident and went to his home country. He then received a call from a landline number, which was from the Abu Dhabi police station.
They said, "We have received a complaint against you; come to our investigation department." However, due to his surgery and treatment, he could not go.
After some time, his bank account was reopened, and he did not receive any further calls. I want to know, if he comes back to the UAE or goes to any other GCC country, will he face any problems?
If someone has a case in the UAE, can they travel to another GCC country?
Please advise!

I want to open an online shop. Do I need a license to open an Etsy shop? 0
I currently live in Sharjah and have a UAE residence visa but I am not a UAE or GCC national. I want to open an online shop (Etsy or Shopify) to sell handmade items, such as crocheted goods, bookmarks, greeting cards, etc.
Do I need a license to open an Etsy shop?
If so, which license do I need to sell my products online, including UAE and worldwide?
How much would it cost me?
Can I keep my residence visa (sponsored by my father) and not change it?

How can we locate a person with an ongoing legal case? 0
Hello,
I am seeking your legal advice regarding a friend who was previously imprisoned in Abu Dhabi. His case there is now closed, but he has another ongoing case in Dubai.
Currently, we have lost contact with him and are unsure of his whereabouts. How can we check where he is or access any other legal facility?
Are there legal procedures to locate a person with an ongoing case?
What steps should we take to get more information about his status and legal position?
