Court fees after issuing a jujgment in favor of an employee
Good afternoon,
My husband filed a labor case against his employer due to nonpayment of salary and gratuity. Last Sept, he received the decision in his favor.
Last week, he received a call from someone from Dubai court asking him to come today at 7 am to discuss his case. When he was there, they showed him a paper to sign that he has to pay court fees, an amount about Dhs. 1,700, not sure the exact but less than 2,000.00.
Is the labor/employee exempted from paying court fees?
Dear Mam,
The court fees are applicable in two scenarios:
1. When the claim is more than 100,000 AED.
2. When the court appoints an expert in the case.
If the claim of your labor case is below 100,000 AED, then there is no court fee imposed against your case. If the court appoints an expert for the case, then the expert fee is payable.
However, before you sign any document, I would advise you to get in touch with the court and request for court-issued order which demands the payment you mentioned above.
