Responding to a police call for clearing a bank debt

Hi.

My bank filed a police case and the police called me to the station.

I want to ask, shall I clear the outstanding and take clearance letter from the bank then go to the police station or first go to police station?

Now, I can clear the full outstanding of the bank. But the question is, do I have to pay the bounced cheque fine as well if I have already obtained the clearance letter from the bank?

Dear Questioner,

I would suggest the following:

  • Check with the bank the status of your criminal case. If the police just called you, for sure the case is still running.
  • Send an email to the bank informing them that you want to reach a settlement with them by paying the total amount. After you send them the email, go to the bank and raise the same. If they are willing to reach a settlement, make sure the settlement letter will be signed by all parties.
  • In case it will take time to reach a settlement with the bank, go to the police (on the day you were called), print the email sent to the bank and explain to them that you're in negotiations with the bank for a settlement and request them to postpone the case for a few weeks until you can bring them the settlement letter and the release letter issued by the bank.
  • Once you have the settlement letter, inform the bank to issue a release letter under your name and to submit the release letter together with the settlement letter to the police.
  • In order for you to be saved, I would suggest you visit the police station to make sure they submitted the letters. In case they did not submit the letters, you can submit them.

You need to pay attention to the settlement letter that you will sign and to the release letter issued by the bank.
