Releasing the passport of a guarantor in a loan case from police
Hi Sir,
I would like to ask for advice.
My sister has a case with a bank in Sharjah and we found out when she came back to the UAE on a visit visa last year.
She was detained in Dubai Airport and brought to Sharjah police on the same day and was released when I gave my passport in exchange.
We tried to settle an amount yet again they keep asking for more and change the settlement amount and came to the point that my sister needs to leave the country leaving my passport still in Sharjah police custody.
What do I need to do or bring to Sharjah court to release my passport?
I would appreciate your kind advice.

Hello dear
I need more information to give you a full consultation. You can communicate with us by phone or email.

Dear Sir,
Thank you for reaching out to me on this.
I understand your issue and trust this is resolvable.
Firstly, can you advise what is the amount of outstanding and what is the cheque amount bounced by the bank before Sharjah Police?
Secondly, can you advise when is the next hearing date (assuming the case has moved to court) or you do not have any information pertaining to this?
Please note that the rules in Sharjah are much more strict than other Emirates. It is not possible to pay a fine and get the case removed.
However, with proper legal representation and submission of documents, the case can be cleared against your sister and your passport can be released.
Currently, the bank has the leverage so it is unlikely they will offer a good settlement.
Further, your sister will not be able to travel until she clears the police case since she has a travel ban as we speak.
Your passport is only kept as a guarantor which can be replaced with some other passport if you wish to.
I believe we need to get all the facts from you in order to advise you better.
You can get in touch with me via email or phone for further assistance and clarification.
Regards,
Hari Wadhwana
