How I can get my cancellation and my dues in my previous company, as I will get a job offer in a company but they need the cancellation paper?

I filed a complaint at the Ministry of Labour and my 1st appointment will be tomorrow. I need my cancellation urgently; please advise.

My company is asking for my passport before my cancellation and they said they will not return my passport unless I have a new visa from another company (my passport is with me).

Also, I need my salary and they said they don't know when they will release it. Please advise, what is the best thing I can do for this issue?

Dear Questioner,

Pursuant to your query, first of all, don't give your passport to your previous employer (company). It is illegal if they keep it with them.

About your appointment tomorrow, we advise you to ask the Ministry of Labour to transfer your case to court and receive a transfer paper from them and after that file a case in the labour court.

After filling the case you can have a temporary work permit from the Labour Ministry to join a new company until your case is finished.

You can cancel your visa after the case judgement. If you want to cancel your visa before this, you have to settle this issue friendly with your previous company.

Would like also to ask, is it ok to request from the court to issue a letter to immigration to facilitate the transfer of my visa to my new employer?

Is it possible or it's better to cancel my visa first from my previous company and then my new employer will issue a visa for me after the case?

Would it be possible for my previous employer puts a ban on me while the case is in court?

- It not the job of the court. The correct way is to file your labour case and take a certificate to make a complaint at the labour ministry and immigration to cancel your labour card and visa.
