Q: I reserved a unit with Azizi and while paying my first instalment I was billed twice by them. They apologised for the mistake and agreed to reverse the amount within a week but they took more than a month and a half to return my money after repeated calls & follow up.
I've paid the booking amount, the first instalment, Oqood fees and their administration fees. I have only signed a reservation form with them and no terms and conditions have been mentioned about cancellation which I guess should be there in the SPA and not in the reservation form.
I would like to know if it is possible to cancel my purchase at this stage (I have not signed the SPA yet)?
They have not registered my unit online on Oqood as yet so can I ask them not to do this as I wish to cancel?
What amount will be refunded by them if I cancel?
Can the DLD set a deadline with terms and conditions for them to return the required amount so that I get it as soon as possible?
Your guidance will be highly appreciated.

Q: When buying an off-plan property from a developer, does the SPA have to be reviewed, agreed and signed by both the buyer and the developer representative before paying the DLD + Oqood?
Is there a local estate law or clause requesting DLD + Oqood should be paid before the SPA is released from the developer to the buyer?
I am seeking this advice because the developer is asking for DLD + Oqood to be paid before the SPA is released despite having paid the initial deposit of 5% as per the Sales Offer schedule.

Termination of sale and purchase agreement for breach by developer

Q: I am in a situation where I have purchased a property and paid Oqood and DLD last year Feb 2017. The agreement was supposed to be ready by the 2nd quarter of 2018.
However, without communicating the developer says it will be ready by the 2nd quarter of 2019. I found this is on his site.
I have paid 30% of my payment by Feb 2018, and now a situation like job issues are going on. I need to cancel my unit.
What are the options? please let me know.
I think after December, my contract is not going to be renewed. So I'm in a big problem.

I have purchased an off-plan apartment in Dubai last year. I paid the deposit, OQOOD registration fees and have been paying all instalments on schedule toward’s the developer's Escrow Account.
However, the developer is delaying issuing the SPA and OQOOD until now with no valid reason, even though they had me sign the SPA from my side on the promise that they’ll sign it after me and attest it from DLD.
It’s been more than a year now, I’ve been asking for both the SPA & OQOOD or refund of my money, yet the developer simply replies with “it’s under process”.
I would prefer now to just terminate the agreement and get a full refund of my payments. is that possible?

The developer is delaying the issuance of the title deed

Q: It has been more than one year since I have made full payment for a ready to move in property. The developer has not given a date for issuing me the title deed.
I complained to DLD. However, they told me that the developer has already been issued a fine, and now I have to take the matter to court.
I have all the required documents to verify the above said.
I want to know the following:
1) Can I sue the developer and ask him for compensation for the delay in issuing the title deed?
2) Can the developer charge me service charges when the title deed is still not issued?
3) How much (approximately) would it cost me to take the matter to court? Is it possible to have outside of the court settlement?

Is the buyer obliged to buy an off-plan property upon sign the booking form?

Q: Hello,
We wanted to buy an off-plan property. Unfortunately, the CEO of the developer ran away for financial reasons and RERA took over.
We only signed the booking form but none of our money has been taken. The SPA was also never signed.
Can we just move on and look at other properties or can RERA ask us to pay the amounts if they decide to choose another developer to finish the project?

The risk of buying a property almost ready for handover without signing SPA

Q: I want to buy an off-plan property but I do NOT want to sign their SPA. The property is almost ready and due for handover in 2-3 months.
The developer is implying that if I pay the full price 100% with no payment plan, it may be possible to bypass signing the SPA, as the property would be paid for 100%.
I don't want to sign the SPA because of a clause inside it which I disagree with on a religious level.

The relationship actually lasted for nine months, and payment was made for two periods. In the third period, due to disagreements between our company and the company to which the supply was made, they refused to pay, noting that the outstanding amount so far is fifty-four thousand dirhams.
