He promised to give me a 3-month salary and other benefits. After a month only gratuity and leave pay have been deposited to my bank account. As per the UAE labour law do I have the right to claim for 3-month salary?

They had made me sign one letter on their Official Letterhead that they have terminated me and will be giving a grace period of one month. This was almost 1.5 months ago. After this now they have made me sign the Cancellation Letter for closing the Contract. They are telling me they will be paying my basic salary and not be paying HR, is that ok by Law? Also, they will be deducting the cost of the car and mobile SIM since the letter which they provided to me. Q: Hi, I was working in a Real Estate company as an agent. Last deal I closed with common commission 22,000 AED. By contract 50% - to me, 50% - to the company. Next day I found a spelling mistake in the name of the company on the cheque and I went to change it. I received from my company Invoice for 11,000 AED (it's their commission 50%) so I broke that cheque on two cheques 50/50%. Company commission - 11,000 AED, another 11,000 AED the buyer made on my name (my commission). Then the company gave me a receipt for their commission. Also, during 14 months I did not receive my salary. My boss did not cancel my visa. I left to Russia after 2 weeks and my boss after 1 month opened a police case against me that I stole 22,000 AED. I have all copies of papers and cheques. Please help me with your advice. I have in Dubai family, sister, my dog and car. And now I can not come back to Dubai because my boss wants me to pay 22,000 AED and get deported. He got his commission but he lied to police that he did not. Police cannot reach me because my UAE SIM-card is not working in Russia. What to do??

Q: A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property. The transfer of the property was blocked due to the court order. According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?

Q: I am working as an agent with a real estate agency. I am new to this industry, just got my visa processed which is why I am still looking forward to applying for RERA. I sold an apartment in an off-plan project which is exclusive with the broker I am working for. The client has paid 20 percent on which the commission should be released, but it has been 2 months I am begging for my own money. Due to all this unprofessional behavior, I resigned and still looking for some help to put pressure on them. I have my name on the SPA and the buyer is also with me. I want them to pay 2 percent which was agreed verbally, without deducting the visa cost which is mentioned on the contract. Please advise.

The real estate broker is insisting on a security cheque issued in the name of the seller which is to be kept by the broker until the day of title deed transfer and to be returned back on the same day. I understand this is "standard practice" but is it a law?

However the company is not running well lately, and it has a risk of insolvency. If it really happens, who should I claim my commission from? By virtue of this Law, a public corporation named the “Real Estate Regulatory Agency” is established in the Emirate of Dubai. It is affiliated to Dubai Land Department. The objective of RERA is to regulate the real estate sector in the Emirate.

This Bylaw regulates the Real Estate Brokers Register in the Emirate of Dubai. No person may engage in real estate brokerage activities in Dubai unless he is licensed by the competent entities and entered in the register, which is maintained by Dubai Land Department.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this law On Evidence in Civil and Commercial Transactions (Law of Evidence) govern evidence in civil and commercial disputes in the UAE.
