Q: Hi Ma'am,
My sister is a Dubai resident (Muslim Sunni) and Pakistani national married to Pakistani person and remained in marriage for 12 years. The person whom she married has this as a 3rd marriage and it was an arranged marriage by our family.
After the marriage, we found the person very narrow-minded and the life was as hell for my sister. To make a long story short, we opened the file/registered the case in Personal Status Court of Dubai in the family section.
After a few initial meetings with the marriage counsellor, they tried to patch but it did not work. In Sharia, this person said several times triple talaq in front of my sister but there were no witnesses for evidence.
The husband is willing to give divorce but denying the financial settlement for my sister as my sister has medical conditions and really need financial support.
I need an expert lawyer who can guide and give the right direction to obtain the financial settlements and all due rights.
Please advise.

Divorce and settlement for Muslim expats in the UAE

Q: I'm Tunisian woman married to a British passport holder and we're both Muslims married in Qatar and live now in UAE. I want to know what happens if I ask for divorce.
We grew apart and he's been nasty with me, threatening me to have a mistress or get married again or even threaten to hit me if I reply to him during an argument. We have a joint account with full ownership (anyone of us has full authority over the account) for both of us but I actually own 90% of the money in it.
Lately, after our relationship started suffering, I discovered he transferred all the money to an off-shore account and he didn't consult me or ask for my permission, until he didn't tell me about it. I don't trust him anymore and want to divorce and have my money.
Would filing for divorce affect me or my assets (I have another separate current account)? Would I be able to get my money back? How will Sharia law affect this process assuming he won't cooperate?
Please advise.

Filing case for maintenance against husband in the UAE

Q: Dear,
I am writing this on behalf of my sister in law:
"I married this guy almost 15 years ago. He left for a job in the UAE. Now he rarely visits me in Pakistan in years. He also got married to some other Pakistani girl in the UAE.
Meanwhile, he is forcing me to live in Pakistan in his own home and does not directly give me the money to take care of myself and my children. He sends the amount to his father and he then assesses my needs and gives me a calculated amount.
Is there any law in the UAE through which I can bind him to pay me my expenses or I can take khulaa (separation)?"
P.S. The lady is really heartbroken and desperate. Please respond asap, I shall be very thankful.

Getting the money paid to husband for years and filing a divorce case

Q: I have been married for 8 years and have been supporting my husband financially since our marriage. He has been using my whole salary regularly.
He has been forcefully asking me to continue my work life as well, as I wanted to quit my job due to certain health issues.
He is using my salary for all our expenses and for his business/debt purposes & not sharing any of his income details. Besides, he is not available anytime for me and does not take responsibility for any of my basic and welfare needs.
Though many of our family members advised us to have children, he delays it. He isn't interested in having children as well. He is interested only in getting financial benefits from me. Somehow, his intentions do not seem right for me.
Hence, it would be really great if I could get advice on this, mainly about the huge money that he has taken from me during these years. Will I be able to wholely claim it back legally?
Plus, in addition to the alimony on divorce grounds, will I be entitled to compensation?

Q: Assalam Alaikum,
I am French and have 4 children, and I am 3 months pregnant.
I reside in the UAE and my husband clearly stated that he is leaving for Turkey because life is less expensive than the UAE and that I will have to pay all the bills here by myself and take care of the kids as I am working here.
What can I do? What about when the baby will be born?
All my children are under my residency (iqama) Alhamdulillah but will I be able to add my baby under my iqama knowing that the father abandoned us and we are not legally divorced?

Can the wife prevent her husband to enter the house she pays rent for?

Q: I filed a divorce case and already attended the 1st reconciliation. My husband agreed to divorce but can't get any mutual agreement.
I want to know if I can kick him out of the house. I am paying the rent and the tenancy contract is under my name. I am paying all the bills (he doesn't pay anything), meaning I am the provider since we got married (2 yrs).
Since I filed for divorce, I don't want to live with him anymore. I asked him to move out but he doesn't want to (He is unemployed).
He is not letting me work when he needs to go and look for a job as no one will take care of our son (either me or him), and my job is at risk because of him.
He is also hiding my car keys so that I will not leave. He already locked us up when I wanted to attend a friend's birthday. He locked us (me & my son) when I did something he didn't like. He left & left the key outside so I can't get out of the house.
Will I be in trouble if I kick him out? Take his things out. Or since he doesn't want to move out, I & my son will go.

Asking wife to contribute to home expenses and her refusal

Q: Dear Sir,
I and my wife both are working in Dubai logistics; shipping field in different companies.
Due to my salary condition, I have asked my wife to support me in the home rent & home expenses but her objection is that she cannot support me in rent as it is the husband's responsibility and it is not good for a wife to pay with husband.
I also informed her that if she cannot help me in this regard, then she should leave the job and sit at home so I will bear all the responsibility and if it is tough for me then I will choose the option to send her back to home country in order to send her expenses.
But she warns me that she will leave me but cannot leave the job. So my questions are:
1. Is not a wife allowed to contribute/support in this regard to her husband?
2. Do the husband have legal rights to force his wife to stop going to work?
3. If the husband asked for a divorce, then what are the terms and conditions from husband's side to release his wife after divorce?

Can a husband force his wife to move out of the house upon filing a case for divorce?

Q: Dear sir/madam,
I am under my company visa and not sponsored by my husband, however, now we live in an apartment that is under his name. He has filed for divorce in India and now suggests we should move to a shared apartment.
Can he force me to move out of our current house? And can he force me to stay in a shared apartment?
He says he cannot afford it but his salary is decent and I know he can still afford the house.

Struggling for financial support for child while the father refuses to pay

Q: Hello Mr. Khaled,
I am in urgent need of help.
I was divorced by the UAE courts on December 30, 2022, and my ex-husband has refused to pay alimony for my child and me.
Our son is 2 years and 9 months old and since his birth, my ex has never supported us. Now that it is a court order and I lost my job last month, I am in dire need of this financial support as it is the right of my son.
My ex says he will contest it, but he is just finding ways to avoid paying, as he has never done so before. I am afraid that he might flee the country.
What can I do in this situation?
I am unable to file an execution case as I do not have any finances.
I am looking forward to a hopeful response.

According to Article 15 of Cabinet Resolution No. 1 of 2022 (“Executive Regulations”), employees occupying supervisory roles are exempt from the provisions of the Labour Law and the Executive Regulations in relation to maximum working hours only if they possess powers equivalent to those of the employer.
Could you please clarify what is meant by "if they possess powers equivalent to those of the employer"?
Currently, we have heads of departments who report to the directors. Will they be eligible for overtime?
Also, those who have a POA to sign contracts will they be eligible?
Or, those who temporarily replace the CEO while he is out, will they be eligible?

حصلت على قرض شخصي وكريدت كارد من مؤسسة للتمويل بإجمالي ٥٠ ألف وتعثرت لفترة والآن يطالبونني بدفع مبلغ ٢٠٠ ألف درهم بالفوائد وكنت أعطيتهم شيك بقيمة ٤٢ ألف وقتها.
سؤالي:
هل يوجد سند لأمر داخل عقد القرض (الأبليكيشن) الخاص بالشركة التي وقعت معها في البداية؟
أم لا يملكون ضمانًا آخر يُمكِّنهم من مقاضاتي به سوى الشيك الذي أعطيته لهم فقط؟

تقديم دعوى ضد مقاول استلم دفعتين من المال وأوقف العمل 0
هناك مشكلة مع مقاول إذ اتفقنا على بناء ملحق داخل منزل خاص ووقعنا العقد واستلم أول دفعة.
اشتغل حسب العقد واستلم الدفعة الثانية وأوقف العمل ويرفض المواصلة. تبين لي بعدما حاولت أن أقدم شكوى ضده أنه يستخدم ختم وعقد لشركة منتهية في سنة 2013 ولا يوجد لديه أي ترخيص.
كيف أستطيع أن أشكوه وبنفس الوقت أواصل البناء؟

My wife and I are non-Muslims. Divorce was settled in our home country court which decided that I am the custodian of the children and no alimony has to be paid to her.
Children are living with me here in the UAE. However, she still resides here in the UAE using a tourist visa. She is planning to file a Maintenance Case against me in the UAE Family Court.
Can she do that?
Am I obliged to pay her alimony?

Cancellation of an off-plan property and seeking refund 0
Hello
I bought an off-plan apartment with a developer, paid half and the other half was supposed to be paid on receiving the apartment which was supposed to be received end of 2019.
But they postponed it till March 2020, and now the project is way behind and no improvement at all as I'm in phase 2 and they are still building phase one.
What can I do to get my money back?
