رفع دعوى ضد مطور عقاري بسبب عدم الالتزام بالجودة المتفق عليها

لقد اشترينا عقارًا في أحد المشاريع من مطور عقاري بسعر ممتاز تبلغ قيمته 5.4 مليون درهم. وتم التسليم في يناير 2019.

لقد وقعنا على العقد حيث بدا كل شيء على ما يرام. ولكن بمجرد انتقال المستأجرين، بدأ الكابوس. لم يمر يوم دون حدوث مشكلة كبيرة.

مؤخرًا، اشتعلت النيران في لوحة المفاتيح وكان من الممكن أن تؤدي إلى حريق كبير يضر بالمستأجرين.

على أي حال، أريد أن أعرف كيف يمكننا المضي قدمًا في تصعيد المشاكل ضد المطور العقاري لعدم التسليم وفقًا لاتفاقية البيع والشراء حيث استخدم مواد رخيصة، وفصل أجزاء من المعدات، بالإضافة إلى العيوب الهيكلية.

لا أريد سوى التأكد من أن المطور العقاري لن يفلت من العقاب بسبب هذا العمل الرديء. لا ينبغي عليهم استغلال العميل والقيام بهذه المواقف السيئة. نحن لا نريد أن يكون مصيرنا مثل الآخرين.

I absolutely understand how frustrated you might feel after investing your hard-earned money and going through this.

I will have to review your Sale and Purchase Agreement to ascertain what they have promised you and also if there is any time limit for you to raise issues regarding the fixtures and fittings.

The reason I want to review is to understand where we stand legally and I wouldn't want to litigate where there is no legal basis.

However, a strong legal notice about the works is a must to deter the developer from conducting such activities in future.
