Q: I have been working with a private company for 2 years and 10 months on an unlimited contract. Three months ago my employer cut Dh 3000 from our salaries and later asked us to sign a letter saying that we accept a deduction until the company's financial condition improves. There has been no change in the contract though.
My employer also increased our working hour by 30 minutes every day, for which we were sent an email.
My questions are:
1. If I leave the company, can I claim the salary which has been deducted back?
2. Will my final dues be calculated based on the salary mentioned in my contract or the reduced salary?
3. Can I ask for overtime for the increased hours? It is mentioned in my contract that overtime will not be paid.

Recalculation of end of service benefits

Q: I joined the company in April 2000 and now I am leaving the company. Just to let you know that in 2009 the company had given every employee their end of service benefits and made everyone sign one paper.
My question is that during that time my basic salary was less but now it has increased. As per now, it looks like the company will only pay the end of service benefits from 2009 till date.
I want to know if I am eligible to get the increased differences of my basic salary from 2000 to 2009 additionally.

Non-payment of salary and the proper legal action

Q: Sir.
I am working in a restaurant as a food supervisor.
I was working in a restaurant in Dubai, where I got an AED 5000 salary. A managing director of a restaurant in Abu Dhabi asked me to join his restaurant.
That time he offered me a salary of AED 7000, so I resigned from my job in the Dubai restaurant.
After I joined the Abu Dhabi restaurant, he mentioned in my labour contract AED 4500 salary only.
That time he said above AED 5000 salary I have to pay more amount for the insurance, and the remaining balance amount he will give cash or cheque. So, I signed the contract.
After that, he did not pay my salary properly. I was working around 11 months, but he paid only 6 months. In these 6 months, he also paid my basic salary only (in my contract, the basic salary is AED 3500 and other allowances are AED 1000, in total salary is AED 4500).
Now, he is saying that he's not going to pay because I bring losses to his business.
So please help me with this situation, Sir.

Is the undocumented salary increment a part of the basic salary or allowances?

Q: I am currently employed by an engineering company since the beginning of 2014, and I have received termination notice in mid-2017 (+3 years service).
The initial full salary with the housing and transportation allowances was AED 20,000.00 and I have the breakdown of the allowances (basic salary, housing and transportation).
It was then raised to AED 30,000.00 in 2015 and the employer simply started to transfer the amount of AED 30,000.00 to my bank account without giving me any revised contract with the new payroll breakdown of the allowances.
Also, the employer never updated the Labor contract with the revised salary of 30,000.00 AED leaving the gratuity computation now open to many ambiguities. I have filed a complaint with the Ministry of Labour to seek advice on my rights.
What would be the best approach to determine the basic salary, housing and transportation from the AED 30,000.00 salary, as this information is now omissive?

Calculation of the End of Service Gratuity upon termination

Q: I am looking for advice on how to best proceed with receiving the amount of gratuity promised in my contract. I have worked for my employer for 4 years on an unlimited contract.
One month before my visa renewal, the employer informed me that they will not renew my visa and will end the working relationship. My contract states that my basic salary is AED 13,000, with no subdivisions.
Now, the employer claims that this was a mistake and they meant to write AED 6,000 as basic salary and allocate the rest for travel, living etc. They are only willing to pay the gratuity based on this amount.
Please advise, what is the amount the employer owes me as gratuity and how to proceed?

Q: Hi,
I joined the company on June 26, 2021. The general manager approved my salary increase on June 28, 2023. My labor contract ends on July 12, 2023.
The HR manager applied my salary increase starting in August 2023. Is this allowed?
Or should it be applicable in July 2023?
Does the labor contract affect the date of the increment?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
